Hi Forum Members,

I have my ILR coming up end of year. I had HSMP (MBA provision) initially which then extended into Tier 1(General). I had a year of Unemployment mid 2009 - 2010 due to recession and could not find another job. But have a full time Job since June 2010.

Could this unemployment cause an issue with ILR application. I have all P60s and P45 except for the year I did not work in. However I was based in the UK and still paying my rents and council taxes.

I have seen that economic activity at time of application is important but one could have periods of unemployment in-between. But not sure if this unemployment could impact my ILR

Your guidance will be highly appreciated.

Well I know someone who is going to apply with 2 year Gap in Job in earlySept but covered with JR HSMP. I have heard of cases of people who got ILR with around 6 months gap. The requriements clearly state that the person

a. should be economically active
b. never took benifits
c. spent last 5 yrs

so if u are economically active at the time of ILR you should get the ILR in my opinion. You may need to prove that during the time u did not have job u lived on ur savings or someone else gave u money so proof for that..

Sorry I forgot to mention that above is true if you are covered by the JR. Tier-1 would be different.

Thanks Winsome. I have seen being economically active as a specific criteria for those applying under JR.

However for Tier 1 there is no such criteria, it only says that will get points as per one of the points table. Hopefully it should work out ok.
