Set (O) Version 04/2011 Vs Set (O) Version 05/2011

Post by zebra3 » Sat Aug 13, 2011 1:56 pm

Hi All,

whats the difference between the forms SET (O) Version 04/2011 and SET (O) Version 05/2011?

my solicitor sent my file to the home office on 8th August 2011 using form SET (O) Version 04/2011 for ILR based on 14 years.

I checked both forms and can not see any difference

Thank you

Ask your solicitor whether application dated 8th August 2011 on a previous form is valid?
Read page 10 of UKBA guidance:

http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

its one of this things, the UKBA editing the form in a month. he will just have to resubmit.

Thank you for that, the only differnce between the 2 forms is section 3 where you tick under what category your are applying.

It is immaterial that what changes have been made in form.
Law is law. To be valid application should be on current version of form subject to exception mentioned at page 10 of UKBA guidance mentioned above.

looks like ur solicitor messed up!. What changes have been made are irrelevant. one must use the latest appliation form at the time of applying.

Ain't that the truth!

...I had a PEO appointment and all my evidence sorted, but had been working on my application since April. 2 days before the appointment at the beginning of June, I had a bad feeling about my form so I googled it and found a new form had been issued. On the bright-side, redoing my application form was another check that it was all in order.

:x Fire your solicitor - or at least ask for a discount on the astronomical fees he's/she's probably charging as an immigration paperwork 'expert'. Perhaps publish the firm name (moderators?) in the form of a review, so nobody else in your neck of the woods suffers their short-sightedness.

I have just checked my bank account online and the home office cashed in my cheque for £972 FEES for the application.

they can still refuse your application. u cant do much now. just notify your solicitor so if home office rejects application due to form error, he knows that he has to pay for re-application.
