ILR application

I have been granted an HSMP visa for 2 years on 18 Sep 2007
and then have been granted T1 visa for another 3 years, but from 24 Aug 2009!
which means, when current T1 visa expired, the total period is only 4 years 11 month and 6 days. I am really confused what I should do, shall I extend my T1 or just apply ILR directly??? Any help will be appreciated.

You created a gap by applying early. However, you can apply for ILR 28 days before the end of your your five year qualifying period. You can apply from 22 Aug.

hi lukapooka, thanks for your reply.

yes, I did apply quite early as they said apply as early as possible on the website. not sure if anyone else has the same experience, but it is a good lesson to me!

now, if I send them the ILR on 22 Aug, what will happen if they refuse my application? Do I still have chance to apply extension? or I have to leave the country immediately? :?

As Lucapooka has said, apply between 22Aug and 24Aug.

This is assuming you entered UK or were issued an in-country leave to remain on 18Sep, and the current visa expires 24Aug.
