Switching from Tier 1 (Gen) to Tier 2 - Labour Market Test

Does one has to undergo the labour Market Test if that Person is willingly switching from Tier 1 to Tier 2.(Strange Case- leaving all the felexibility of Tier -1) I understand that for Tier 1 you dont need any but the company for some reason wants to recruit under Tier 2 and not under Tier 1.

I would appreciate some advice if the person has to give Labour Market Test or Not and how to proceed.

How did you get the job? If it was through advertisements, etc then you might already have fulfilled the resident labour test.

Sorry not to mention in my previous query. The person is already in the UK past 2 years on Tier 1 and is working for a software company past 1 year now, but due to some company's remuneration policy. The same software company is interested to recruit the same employee who has been working for them past one year under Tier 2 rather than Tier 1. The company has the enquired whether the employee has to undergo the Labour Market Test.

The RLMT wont be required if he's been working for more than 6 months on PSW with the employer.

Thanks for your reply.. RLMT is exempted for Tier 1 (PSW). but here the candidate is on Tier 1 (General) working in the same company for past 1 year.

apparently there is new rule so make sure you check that out as well.
according to it you can not switch from Tier 1 general to any category inside UK. for that you require to go back to your home country.
