Tier 1 General extension queries

Post by ref786 » Wed Sep 14, 2011 9:56 am

Hi There,

There is a quick question. I am gonna be 31 yrs on 20 of november this year and my visa is valid till 6 dec 2011. That means I will lose points if i apply after 20 movember (will get 10 points instead of 20) and it will mess up everything. I have had this situation becasue I made the application for first time for teir 1 on 19 nov 2008 (I was turning to 28 and wanted 20 points for age) but home office gave me the visa from 6 dec 2011. So I am wondering, If its possible to apply for extension before 20 nov 2011 although visa expires on 6 dec 2011 or it doesnt matter if I apply just before my Visa expires?

Please guide me.

Thanks

Yes, but try not apply any longer than a month before the expiry.

You cannot lose points for age when doing an extension. The number of points you get is based on your age when you applied initially, not your current age.

How about earning and qualification? Can u show more or less earning or it has to be same . I applied tier 1 general with bachelor degree but i hav master degree too. When doing extension, can i use master degree to gain point? Thks

Hi mulderpf,
Thats a good news then. That means, When applying for tier 1 i have already met the age criteria and secured 20 points so all I need is to show required income for extension and can apply before my visa expires?

Thanks

I agree with Mulderpf as it is stated in the guidance notes as follows:

"53. If the applicant was fi rst granted leave in the categories of Highly Skilled Migrant, Writer, Composter or Artist, Self -employed lawyer or Tier 1 (General) Migrant and has not been granted leave in any category other
than those listed here since the fi rst grant of leave, points will be awarded based on the applicant’s age at the date of the application for that fi rst grant of leave. If the applicant has been granted leave since his fi rst grant
of leave in a category not listed in this paragraph, points will be awarded based on his age at the date of application for a grant of leave in a category listed in this paragraph where leave has not been granted in any category not listed in this paragraph between that grant of leave and the current application. To claim these points, applicants must fall within the age bands specified."

I would like to ask one question regarding tier 1 extension. The question is if it is must to apply exactly a day before of visa expiry so that they cant start visa before the expiry date? I mean if I apply a week before lets say 1 December 2011 and actual expiry date is 5 December 2011, then they will extend it from 1 Dec for another 2 years not from 5 December that mean at the end of 2 years I will not be able to show 5 years and wont be eligible for indefinite stay either, is that right?

Please clarify.

Thanks

If you wish to avoid another extension before you become eligible for settlement, apply no earlier than 28 days before expiry of current leave.
