ILR-Due. Shortage of Income

I have to apply for ILR in few months time
Look at my case first

1. Got WP in 2006
2 Got Tier 1 in 2010
3. Income band for Tier 1 was 30000.
4. The company i was working for went bankrupt in 2010 and i was unemployed for 7 months. Totally unemployed lived on my savings.
5.Started my self employment business at end of 2010.
6.Got job in May 2011 .
. Have to apply ILR in December 2011.

Now my Questions
1(a) Do i need to show my income for all years at 30000 ?

1 (b) Do i need to show my income of 30000 for last 12 months before application for ILR.


1(c). I have my p60s for four years but last year when i was unemployed and i started my Self employment work . I have no p60 but some paper work from HMRC showing my self employment income and the tax i paid later on.

BUt the problem is in that last year my income was only 5000.

How will this effect my case ? since i did not earn 30 k in one of the year.

2. Since i got job in may 2011 , and am also continuing my self employment activites my total income for 12 months before applying ILR will be more than 35 k. ( including salary & Profits)

3. Since i have got combination of job & Salary can i apply in person on window?

4. What documents for self employment should i take with me.

5. Can i apply 28 days before expiry of my 5 years on work visa.

6. Any other suggestion that will help my case. Including full list of documents which i should take with me.

7. What form number should be used to apply for ILR in my case ?

You advise and suggestion are highly appreciated

you might have to get your SOC code etc from the company when you were on WP but as you moved on to Tier1 you need to show the income for relevant points, in your case, 30,000. it can be 12 months from last 15 months and you don't have to show it in 12 months, if you can show and support earnings of 30K in 6 months then that should be OK

you need 30K as this is now a requirement for points otherwise your application for ILR will be rejected

accountant letters and supporting docs as much as you can.

what is ur current income? if its more than 30k per annum, you can wait till you have earned that much and then apply rather than applying in december 2011. as you got Tier 1 in 2010, you should have another 2 years visa validity.

My last 12 months income will be more than 31 as a combination of salary and profit from business.

Hi,

My friend, you will get the PR 100% under the redundancy category as you have lost job due to your company closed.

Hire a Immigration lawyer(from OISC) on No Win No Fee basis, its worth paying some money to immigration lawyers and you will get the PR...I am sure.

where is this "redundancy category" mentioned in the SET(O) form/guidelines?

as per rules, you will have to score the minimum points for salary 12 months within the last 15 months for your ILR application.

You basically need the minimum earning to score the minimum points on tier 1 in any of your last 15 months. Whether that means it is more than 30,000 or less than 30,000 almost becomes irrelevant because if you score the minumum points based on 28,000 earning than you qualify for ILR.
