Dear All

Thank you for all your support and help and advised given in the past. I am so dis appointed today due to my own mistake.

I had 2 or 3 drinks with my friend got cought by Garda . Pushed me on the floor bang my nose start bleeding they did not care. Took me in Local Garda station Took my breath test which i gave no result came i do not know why ..NO option was given for blood or urine test

Still charged under section 48 which mean i will put off from driving for next 4 years .
No one else drive in home . 10 month old irish born baby and Eu national wife and i am non eu national .

I dont think i have any future left here i am thinking to leave today or tomarrow in some other country because they will not give me nationallity because of this conviction ...........Any advice .

hey man dont do anything in rush.if your happy in ireland .what is the point to leave the country.i know you make silly mistake but its happen.the good thing is you didnot crash into somebody.otherwise you could be prosecuted.i think for you best is stay calm this moment.once you have job here.there is no point to leave the country.all europe have recession.its very hard to find job.but anyway you have still right to live in ireland .it will be renew easily.just make sure stay calm and happy.you should think about your family first please dont do anything silly.

I cannot advise you on your application but getting done for drink driving is not an automatic four year driving ban.

It could be at most, two years. I know several people who have got two years and were able to get their licence back after one year.

And in some cases, the drink driving charge is struck out due to technical issues. In fact, in many cases this happens.

So I wouldn't lose hope yet. Get some legal advice on this.

Other than that, I hope you have learned your lesson about drinking and driving.

thanks guys for your moral support .

The issue here is that i was not drunk i knew if they carry honest breath test and also take my urine or blood samaple i am 100% positive it will be under the limit

At the time of arrest i was beaten by garda badly which can be supported with pics and hospital report also.

Now i have spoken so many solicitors and they all saying i have to pay to get representation in the court becz no chance to get free legal aid.

I am already strrugling with mortgage i have 23000 arrears bank saying to put house for sale or pay arrears .I ask all family friends for help but no chance

I dont know if there any help out i spoke to immigration council and all other legal firms out which offering legal help. no chance

If i get ban then i will lost job (part time)

i am in one way street now which is cul de suc.............

It was really a mistake by drinking driving even if you are Irish. Don't support Garda beating you up and if it did happen then you need a lawyer.
However, no-one is above mistake, so you need to pull yourself together and consider a proper action. If your job required a cleaned driving licence then look for another job. There are many out there without driving licence that are working.

Visit legal aid board you probably will be accepted on hardship grounds, issue is that the case has to go to court for you to get it imho...

Wouldn't recommend FLAC at all. We went to them before we submitted our EU treaty rights application last year and they had no idea what the directive 2004/38/EC was or the freedom of movement. I knew more than they did and that is saying something.

You are right about the immigration perspective. That is because the local solicitors who chip in are from criminal law/business law area mostly they are not competent in immigration, usually immigration ones don't go in. the op is worried about drink drive charge those solicitors deal with that on day to day basis.

There is a specialist Immigration Law free Flac clinic at the CIC, MACRO Community Centre, Dublin 7, on Thursdays, must phone for an appointment.
