Was I out of Status?

Post by FresnoGirl » Wed Sep 06, 2006 8:14 pm

Hi!

I would like to know if I was out of status. I am not sure. Yes I'm
lame. :-(

I would like to know, because I requested an advance parole to have
just in case something happened to my family in Mexico, so I could go
back on a short notice, as my dear grandmother is elderly and not doing
so well healthwise.

I entered this country............................ August 15th, 2005
I got married (spur of the moment) .........October 31st 2005
I sent my package................................ February 13th, 2006
My form I-94 expired .............................February 14th, 2006
USCIS received package....................... March 02nd, 2006
Rejection Notice....................................March 09th, 2006
Re-sent Documents ..............................August 15th, 2006
Receipt Notice .....................................August 25th, 2006
Scheduled Biometric Apptm...................September 12, 2006

I need to know if I incurred in illegal stay, because I have heard that
even if you get an advance parole, when you try to re-enter the country
they might ban you for 3 or 10 years. Even if the USCIS previously
gave you the advance parole.

Please someone help.

I really appreciate it.

Thanks

Yes you are considered out of status when your I-94 expired. Even when you have Advance Parole in hand it is still up to the border officer's descretion whether or not to grant you entry.
