when to apply ILR

Post by rahi14 » Thu Apr 07, 2011 10:32 am

Hi

I came to UK on Business visa on 22 October 2006, went back to India on 22 Dec 2006. Then came back on WP1 on 5 January 2007, went back to India on 5 April. Then came back on WP2 on 2 June 2007 and am here since then with my family.

Business Visa - 22.10.06 - 22.12.06
Gap 1 --
Work Permit 1 - 5.01.07 - 21.04.07
Gap 2 --
Work Permit 2 - 2.06.07 - till date (went on 3 week vacation to India)

Can anyone please suggest, when can I apply for ILR .

Thanks in advance for your response.

(sorry, have edited the year)

Assuming that you had no valid visa between april and june 2008, you qualify in May 2013 (28 days before 2nd June 2013) as per current rules

Sorry, have edited the year in my previous post.

I went back to India to change work permit(Tier 2) as the first work permit didnt allow dependents. I had visa during that period but came back on a different work permit

A quick question please -
I entered U.K on WP1 (2 years validity), stayed for 5 months and then went back to India to get it changed to another WP i.e WP2. I stayed in India for about 45 days before coming back to U.K on WP2. My WP1 was valid while this changeover was happening and during these 45 days I had a rented house in U.K and was economically active, although a very less allowance in GBP was being paid since I was based out of U.K at that time. Is this considered a break in residency or can the initial 5 months period be counted towards 5 year stay ?

Thanks in advance

Depends on how a caseworker interprets the rules and applies discretion. So no one can tell you for sure.
