DISCRETIONARY LEAVE TO REMAIN

Post by ellamoon45 » Tue Oct 04, 2011 2:35 am

Hi, im mexican got married in the muslim way which is no legal in 2009 in UK with a british citizen, i came with a turist visa, then we went back and found out i was pregnant so we flew back England and stayed for 6 months with turist visa had my baby here, she is british, then we went back Mexico for a couple of months now we are back in England but cause we have to comeback in such a pressure cause my mother in law was in the hospital i really never thought on a visa to live here permanently, now we been here for over 2 months he have a good job, i take care of my mother in law who is ill, my question is cause im under a turist visa, so we been together for over 2 years and a half.

Am I elegibly for a DLR visa under my family grounds (partner and daughter) or will they denied it? I even have a NATIONAL INSURANCE NUMBER when my usband apply for some benefit i cant remember when i gave birth.
Which form should I use?
Can i do it myself or i need a solicitor.

I would appreciate the advice.

1. I came in 2009 to meet a guy i met on internet, we flew back to Mexico after 6 months i was pregnant, so we came to England to have the baby ( as a tourist never ask for a spouse visa or nothing ) by that time they give me national insurance number which i never ask for but they gave me one, so i left the country after 6 months and then we been in and out, never overstayed or worked in England.
My partner and my daughter are british, so now i've been here for almost 6 months and i dont want to overstay but i have no intention to go back Mexico until march for just 3 months so the problem now is if i go to another country like FRANCE OR SPAIN for like a week or two when i comeback will they let me in or not?? They never really ask me that many questions in Border control.

Can i ask for a Discretionary Leave to Remain will that take too long?
Or should i apply for a spouse visa in Mexico, but will the national insurance number be negative... ADVICE PLEASE...
