Tier2 & WP migrants - Technical changes to rules

A minor technical change to the evidential requirements for settlement - from 31 October, migrants under Tier 2 and work permit holders will need to provide supporting documents as proof of their income before they are granted settlement;
Read points 6 - 13 of Statement of Changes in Immigration Rules (HC 1511). See also 7.1 - 7.3.


Expect SET(O) form to be revised. The exact requirement (documentary evidences as proof of their income) will be known then.

Expect SET(O) form to be revised. The exact requirement (documentary evidences as proof of their income) will be known then.
3 months payslips and bankstatements are already a requirement. Just wondering what else they can ask for? There seems to be no other document to prove your income unless they add P60s which is though not mentioned is usually asked.

may be it is P60s or could be you need to have minimum X amount of money in the bank so they can be sure you have enough money before you may ask for benefits

3 months payslips and bankstatements are already a requirement, but it's not written in the Immigration Rules, and according to current Immigration Rules, the only evidence needed regarding salary requirement is your employer letter, although in practice payslip and bank statement are asked for all the time. I guess with the new change it'll clearly set out in the application form what else is needed as evidence, ie. payslip and bank statement. I think this is just to make the current rules water proof rather than something new.

Not sure about P60 though, say if you apply today, it'll only prove your income as late as 6 month ago, not what you "are" paid right now.

New rule effective from 31st October.......

From 31 October 2011, there will be further changes to the Immigration Rules. Work permit holders and Tier 2 migrants will need to provide specified documents to confirm that they are being paid at or above the appropriate rate for their job. This is in addition to the employer's confirmation.

From 31 October, any settlement application by a Tier 2 migrant or a work permit holder must include:

a payslip and a personal bank or building society statement; or
a payslip and a building society pass book.
If they do not provide this evidence, their application may be refused.

Before we amended the Immigration Rules in April to incorporate an income requirement for settlement, we conducted an equality impact assessment. You can find this in our Impact assessments section. The 31 October changes to the Rules are considered to be relatively minor and do not change that assessment. We will continue to have regard to the equality considerations of these changes, and will work to limit or mitigate, where possible, any adverse impact that is identified.

Moderators, I am confused with the above technical changes.The Payslips and bank staments (3 months) are already a required one for ILR what they are trying to achive with the above changes? Does this mean only one 'a payslip and a personal bank or building society statement' is needed for the proof of income??Thanks

Despite the earlier form mentioning the requirement of providing 3 months' payslips there was no such requirement - this has been explained in the FAQs topic.

But now it is mandatory for both WP holders and Tier 2 migrants to provide 1 payslip and a corroborating bank statement.
