Tier 1 General Extension - Delayed application

I might be in a difficult situation and would appreciate some advice please.

I hired qualified solicitors Drummond Miller in a hope that he would be more organised and up to date.

I prepared everything for him and he assured me that application would be sent by 06 September 2011.

I started chasing it up with him on several occasions between 06 September - 03 Oct through email, phone and contact his secretary.

The reply I got was on 04 Oct that its too early to report the application as missing.

And then I received acknowledgment by Home Office on 10 Oct 2011 dated 05 Oct 2011 following biometrics invitation yesterday.

I am in an impression that my application was delayed to be sent and finally got sent on 03 Oct 2011 after numerous reminders by myself.

Now I am worried as the documents I gave him with regards to maintenance funds, bank statements and payslips would have been obsolete by 03 Oct 2011.

I need to know what my options are in the likely event of my application being rejected by Home Office. My VISA ran out on 13 Oct 2011.

I would really appreciate some advice here please before I start packing up my bags.
