CoS allocation and assign

Hi All,

I am currently on PSW and working with my current employer since 20th July ,2011. My PSW expires on the 27th of January and I am hoping to apply between 21st of January and 27th of January as that is when I qualify the 6 months clause.

My employer had run out of allocation for which they requested an increase in allocation. They have today recieved confirmation that their request for increase has been accepted and now they have the CoS to sponsor me.

Obviously, the next step is to assign this CoS to me. I need to confirm when should they assign this to me . Should they only assign after the 20th of January, as that is when I qualify the six months clause or could it be before it?

The employer should not assign a CoS that has a joining date more than three months away.

With joining date as 28-Jan, IMHO, the employer may assign a CoS to you on / after 28-Oct.

Hi ,

Thanks for your reply. Does it take too long to assign CoS. If not then I guess we are OK to schedule the assigning for 23rd January. That way we have all the clauses covered.

Why do you think that you'll not have all clauses covered if the CoS is assigned to you between 28-Oct and 22-Jan?

What if the IT system used to apply for and issue CoS goes down between 21-Jan and 27-Jan? :?

The reason I have doubts is because I would not have completed 6 months employment on the 28th of October. And I spoke to UKBA help line today and he advised that the unrestricted CoS becomes applicable once the employee qualifies for it . Hence I wish to avoid the situation where the UKBA says that my employer may have assigned the CoS before I even qualified for it.
