Dear All,

Though I have posted this before. However, with my scenerio below, I have booked for apperance for ILR at the PEO in Croydon on 7 Nov, 2011. The question is whether or not to proceed.

Can somebody help please?

My situation as stated earlier on is as below, my current leave expires on 29 Novemebr 2011.

The details of my situation are highlighted below;

* Initial letter of HSMP approval issued on 26 July, 2006
* 2 years Entrance clearance granted from 28 Nov 2006 to 29 Nov 2008
*First entered UK on 24 Jan 2007
*Travel back home on 22 Feb, 2007 and back in UK on 19th May, 2007 (No employement yet in UK).
* Travel back home on 27th May, 2007 and back in UK on 10th June, 2007 (No employment yet in UK)
* Start working as a Quantity Surveyor on 18 June 2007 till today (no break in employment)
* Visa granted under HSMP JR for further 3 years from Nov 2008 to 29 Nov 2011.
* only 4 P60 is available now i.e. April 2008, 2009, 2010 and 2011



Detail of Holidays of paid holiday abroad are;

*On holiday from 28th Oct, 2007 and back in UK on 11th Nov, 2007
*On holiday from 8th Apr 2009 and back in UK on 22nd Mar 2009
*On Holiday abroad from 8th Aug 2010 and back in UK on 22nd Aug 2010

I have sought for advice from some lawyers and the feedback is that I need to apply for another extension before I can qualify for ILR.

Please share with me your experience and your advise.

Please, is there anyone in my shoe that has got an experience.

"Q - Do I require P60s for all 5 years?"
If you search the forum, you'll observe that not everyone (making in-person application) have been asked for P60s covering all the 5 years. It all depends on the caseworker.

The question is - what if the caseworker asks for them and you're unable to provide? Do you want to risk a refusal?

Do you have payslips for the year(s) that you do not have P60s for?

Thank you sushdmehta, if you have a look at my earlier post the the reason why I am only having 4 instead of 5 P60 is because of when I started working. After entering UK in January 2007, I was not employed until June 2007. Therefore, I have got only 4 P60 for tax year ending April 2008, 2009, 2010, 2011.

Yes, I have got payslip for months April 2011 to date (Oct 2011).

Do you still think this will be a problem. My appointment at PEO is 7 November 2011.

Then you cannot be expected to possess a P60 for the period in question or payslips or bank statements reflecting salary credit.
So where's the problem ... when you do not have something that you cannot be expected to have?

That you were unemployed for a few initial months then will have no affect on the outcome of your settlement application.

I lost about 60 days from the date of granting my entrance clearance and first entrance into UK. See below the detail leaves to date.

Entrance Clearance stamped 28 November 2006

First entry is 24 January 2007

(Date Left UK) (Date Entered UK) ( Absence in days)

22/02/2007 - 20/05/2007 - 86 days absence (still searching for work)

27/05/2007 - 10/06/2007 - 13 days absence (still searching for work)

14/10/2007 - 28/10/2007 - 13 days - Annual holiday with pay

10/03/2009 - 21/03/2009 - 11 days - Annual holiday with pay

09/08/2010- 22/08/2010 - 13 days- Annual holiday with pay

In summary total abscence is about 136 days, this is inclusive of 37 days annual paid holiday.


Please I need your senior advice. Remember my appperance at PEO is 7 November 2011
