EEA2. Need passport back. Few questions.

Hi all, I am non-EEA national wife of EEA national Treaty Rights (my husband).

We applied for EEA1 and EEA2. My husband is EU national, he is permanent employment in UK.

EEA1 & EEA2 Application sent on 14/07/2011
EEA1 and COA Received in one pack 08/08/2011
Resident Card still waiting.

We will need travel to Czech republic next month. I non-EEA, but I have permanent residence in Czech republic and not need visa for enter to Schengen countries.

We plan ask UKBA about return my passport.

1. Can I re-enter the UK without problems? My EEA Family Permit already expired. Can I enter UK with expired EEA Family Permit and with COA?

2. If UKBA send my passport back, I will need again fresh apply for eea2, or eea2 will continue processing?

3. Can I receive RC for plain sheet of paper or I will need again send my passport back to UKBA?

Really worry about RC waiting… :(

Simplegirl, I wish there were simple answers...

1. You can ask for your passport back. If the UK residence card is not ready, you will need another family permit (nothing for Schengen of course).
2. If you ask for your passport back, it will not reset UK residence card application.
3. If they do not have your passport at the time of issue they will issue it on a scrap of paper. Should be a proper ID type card, but UK likes to issue it as a vignette in a passport; if they have no passport it will be issued on an A4 page, which will need to be kept in pristine condition.

For example, if I ask my passport back and travel to Czech republic.
I in Czech republic, and HO issue my RC on an A4 page, and send to our UK adress. I can not go to UK without EEA FP back? Really? :cry:
I think, apply to new family permit is complicated, first time we prepared so many documents.

Anybody try to enter in UK just with CoA? Mayby CoA is enough for traveling? I really don't have right re-enter UK? If my EEA husband will travel with me?

several people have travelled with COA and got back without a problem. If you drive then you will only encounter UKBA officials who you can easily persuade and enter. The problem may be if you attempt to FLY back to the UK, the airline may not allow you to board the plane in the first place without the necessary visa. Finally, if so it happens that you get RC issued while away, nothing stops your friend from posting it to you while you are in the Czech Republic. Although that depends how long you are going for, but is an option.

Are you a visa national? You will not have problem entering the UK with a CoA once you get to the UK. The problem might be getting on the flight.
