Tier 1 General (points for bachelor Degree)

Tier 1 General (points for bachelor Degree)

As per Appendix A and paragraph 13:

13. An applicant will be awarded no points for a Bachelor's degree if:

(a) his last grant of entry clearance was as a Tier 1 (General) Migrant under the rules in place between 31 March 2009 and 5 April 2010, or

(b) (i) he has had leave to remain as a Tier 1 (General) Migrant under the rules in place between 31 March 2009 and 5 April 2010, and

(ii) his previous entry clearance, leave to enter or leave to remain before that leave was not as a Highly skilled Migrant, as a Writer, Composer or artist, as a self-employed lawyer, or as a Tier 1 (General) Migrant.

My initial Tier 1 (General) application was submitted in the month of Oct 2008 which got rejected on 25th Nov 2008 and we applied for Admin review on 28th Nov 2008.
Finally it got approved after 4 months and the date on 'admin review document' which i got from the admin reviewer 'British Deputy High Commission' Chennai is 25th Mar 2009.
But I got the visa on 14th Apr 2009, so I would like to know whether I come under the rules in place between 31 March 2009 and 5 April 2010? And that whether or not I'll get the points for my bachelor degree (though I got the bachelor degree point in my first application)?

You applied under the rules in place before 5 April 2010 and received points for a bachelors therefore you will be entitled to the same points for the same qualification

Thanks for the quick reply.

But I think you meant the date as 31st Mar 2009 and not 5th Apr 2010. So since I applied before 31st Mar 2009 so I won't come under that rule which starts from 31st Mar and hence i will be getting the point for education. So the point is we come under the rule which exists at the time of application of Tier 1 and not at the time of issue of visa.
Please clarify if I am wrong.

And I have one more query regarding the earnings.

Is it necessary to show the earning of all the 12 months in the last 15 months. Or we can show the earnings of the last 11 months if I satisfy the sufficient income for the required points?

No.

Your application was assessed on the basis on the rules in place on the day you submitted the application in October 2008.

Earning for 11 months rather than 12 months

For example, i require the earning of 29K per year to get 30 points of my earnings but since my annual salary is 32K, I earn the required 29K in 11 months only. So can I show earnings for last 11 months if my earning is sufficient for the required points?

Yes, not a problem.
