Hi, all
i applied for tier 1 general in april but got refuse.
as my leave still valid they didn't give me appeal right.
now i m thinking to go for jr.
is there anybody knows a good solicitor?who is successful tier 1 general
jr ground? then plz pm me his detail.
is there anyone in same boat plz share.

well
as i m in employment and self emplyment both. i got all claim points.
but eco said my self employment invoice could n't varify.
thats why they refuse my application.

Is that the only reason? Did you privide the name and address of the clients?? And did the case worker tried to contact the clients ??

Clients not in UK but overseas?
Do you have 20K-30K to spare to bear the cost of JR, should UKBA decide to contest your claims?

Were the clients overseas?? I have read a post where the client were overseas and UKBA tried to contact them through phone . Did they tried that in your case?

Thanks for your reply friends.i m self emplyed here not overseas.
they could verify some of my clients but others already relocated some other place. on the top of that they are not interested now to do that.
and only for this reason eco said they could not standard verify.
only for few clients ignore to reply i can't suffer.that's not fair.
this is not my resposibility who reply or not.i submit all related document.
thats why i m thinking shall i go for jr or not. can i win?
help me guys i m really in trouble.

When did you apply for tier 1 general,when did you do biometric and when did you get reply from them?
My best advice for you is to see an immigration lawyer

Defenitely you should go through a lawyer .. And one more thing I want to ask , did the case worker tried to verify all your clients ?? Through letters or phone calls?? Do you operate through sold trader/ limited company?

what does it mean no right to appeal? can they refuse your application and not to give you the right to appeal?

I think they can if you still have you visa left when they give their decision they can say , no right to appeal.. That's what I think ..

I'm planning to extend my visa based on overseas earnings. so they might refuse may application with no right to appeal just because they can't verify ?

One is given the right to appeal only when a decision is made on an application after the current leave has expired (or at such time that the leave will expire by the time the decision is communicated to the applicant).
Whether one will have a right of appeal or not does not depend on the "reason(s) of refusal".

hi,
thanks all of u.
first of all
i have still valid leave here,which is expire next year,thats why they didn't
give right of appeal
second
i m a sole trader in limited company.company is registerd.
third
they send letter to all my clients to verify invoices
but few of them replied others not.
thats why they said verification not done standard.
only the reason of my application refuse.
what can i do now.

What I think is go through a experienced layer
One more thing .. Either you are a sole trader operating in a business structure or a employee or director of the registered company ..
Can you please tell what documents you had provided for your self employement which lead them to verify the clients ..
Did you had required papers and two proof for your self employment .
And according to my understanding sole trader and directors of limited company are two different structures..
Seniors please rectify if I am wrong..

hi,friends,
i provided all necessery documents.
my lawyer already sent pre action protocol letter against refusal.and requested them to reconsider my application.otherwise we wll go for jr.
they replied and ask us to
if we not go for jr then they will reconsider my application.
plz give your opinion guys what happend next.
are they going to approved or not?
shall i go for jr?
how long will take the decision made. so worried
plz all are welcome to give your valuable opinion.
is there anybody got same experience,plz share then everybody can
get benifited from your advice.

Agreeing to reconsider doesn't necessarily mean an approval. They may reconsider and again refuse for the same reason(s).
If you have the money to spare and believe that the refusal is unlawful, proceed with JR. As for the timeline, no one can predict that for you as it depends on the availability of court dates and of the judge assigned to the case (if request for JR is granted, that is). That said, it is a long drawn process and can take several months.

Sorry to hear this. I hope your application would be successful in reconsideration.
I wanted to ask you what documents you had send for previous earning proof?
Did you send the contract documents for self employement.
Were you working through you own limited company as a director with 100% share holding.
