ILR! Proof of address

Post by ali_111 » Sun Nov 06, 2011 2:03 am

Dear all,

My question is related to Cohabitant proof, Please send me link if this is already answered as i couldnt find it.
I have got HSMP approval in Oct 2006 and further extention got in december 2009 untill dec 2011. My wife join me in april 2009 but our address are diferent as some one gave me advise earlier its not necessary for us to have a same address to be honest i didnt bother to change it either as my post was still coming at my uncles address. I dont have any joint account with her except a tenancy agreement!

Can someone advise as i am planning to apply ILR in end of Nov 2011.

Bad advice. How will you prove that your marriage is subsisting?

Refer to SET(M) for examples of acceptable documents to demonstrate co-habitation.

Technically, dependants of HSMP migrants covered by HSMP JR are not subject to the "2 year" qualifying residential period when applying for settlement - so you should not be asked to provide evidence of cohabitation.

But, more often than not, UKBA caseworkers seem to be ignorant of this. Therefore, it is better to be prepared than be refused for not providing evidence of "subsisting relationship / cohabitation" (refusal for such reason will be unlawful).
