When to apply ILR?

Post by minsurfnet » Tue Nov 08, 2011 7:01 pm

Hi All,

First of all thanks to this forum and moderator to support such a great and wealth of info place. Thanks,

UK WP - Issue / Stamped Date: 12/20/2006,
UK First Entry Date: 17/02/2007,
WP Switch to another Employer: 17/11/2007
Switch to Tier-1 : 12/04/2009
Tier-1 Valid : 11/04/2012.

Total Days out of UK are: 174 Days break in to multiple exit and entry.
7 Days: Paid Business Trip
45 Days: for Holidays + Marriage
3 Days: Paid Business Trip
3 Days: Paid Business Trip
21 Days: Paid Holidays
35 Days: Holidays + Business
15 Days: Father Death - Funeral
45 Days: Holidays + Business

My questions are:
1. When can I apply for ILR? either count from the date of stamp or date of first Entry in to UK?

2. I suppose I'm still under the total limit of 180 Days in 5 Years. Do I still need letters from Employer about business holidays etc?

Please reply.

Many thanks,.

date format is confusing mm/dd/yyyy or dd/mm/yyyy

12/20/2006 and 17/02/2006.

Anyways did you counter days from WP Issue to your first entry in UK.

Days outside UK are not clear whether are Paid leaves/ Business trip / Unpaid leave

Good catch. it should be dd/mm/yyyy

The correct date is 20/12/2006 for the first time WP was issued/stamped. The Date of Entry is 17/02/2007.

Total days between WP issue to first Entry in UK are 59 Days.

Total Days out of UK are: 174 Days break in to multiple exit and entry.
7 Days: Paid Business Trip
45 Days: for Holidays + Marriage (4 Weeks paid leave, 3 weeks unpaid)
3 Days: Paid Business Trip
3 Days: Paid Business Trip
21 Days: Paid Holidays
35 Days: Holidays + Business - unpaid holidays
15 Days: Father Death - Funeral - unpaid holidays
45 Days: Holidays + Business unpaid holidays

I hope this make a bit clear.

Thanks.

I think it should be 28 days before your first entry in UK ( which is Feb 07)

Because you changed immigration categories and the timing of the switch(es) was of your choosing, you should apply for settlement within the 28 days window preceding the 5th anniversary of your entry in to UK as an economic migrant (17 Feb 2012).
Life isn't fair, but you can be!

Hi Sushdmehta,

thanks for your reply.

How about holidays? Since I'm still short of 180 Days policy. Do I still need to provide evidence to my holidays? for example. business trips. etc.

please advice.

regards,
Syed
