How early could I apply for ILR?

Post by mk357 » Thu Nov 10, 2011 12:20 pm

Hi everyone,
A dumb question. I entered into the UK on 21 Jan 2007. Would I be OK to apply for ILR on the 23 Dec 2011 (Fri)? as after that there are 4 days holidays and on the 27 Dec my next bank statement would be due so I would then have to wait for another few days to get the next bank statement due to the christmas holidays. It could well goto the new year. I am not sure whether the day I entered and the day I apply for ILR are included or excluded in the 28 days period?

I am in similar dilemma....
I entered on 20th January, can I apply on 23rd of December?......or should I wait for a date after the long weekend i.e after 27th?

Thanks for your reply..........but not very helpful.

I know the 28days rule..........but should I be counting the anniversary date as the 28th day?
Using time and date website and subtracting 28 days the earliest application date comes to 23rd of Dec whereas if I count the date of anniversary (20th Jan) as the 28th day it becomes 24th of Dec.

24th to 27th Dec is national holiday.

I hope someone can clarify for me please. Thanks in advance.

You have got one day advantage. If I leave it to the week starting Dec 28th then I'll have to wait for the Nov bank statement which is normally sent on 27th but due to the holodays I would doubt that it would arrive in that week in which case I'll have to wait till january. Which means that my children would start going to school and I would not be able to take them with me. Lets see what happens.

And I thought I was the lone one to get caught in this scneario. I entered on 21st January 2007.

Well UKBA Customer care recommended latest I can do is "28th December" only.

Hence,I have taken appointment for 10th of January , my Bank statements are due on 4th of each month , I expect december's statement to get delayed but before my appointment date.

Alternative: just in case if applicant date of first arrival in UK and visa issue date is within 3 months gap, one can choose to put visa issue date as starting date of 5 year term. Applicant should do it only if current visa is expiring in few months from now. Also its not a guideline but an advantage which can be given to applicant on discreet decision of caseworker.

And to be safe wait for sometime, if current visa permits.
