marriage

Post by leony » Mon Nov 07, 2011 7:22 pm

Hi,

I have Tier 1 visa until March 2012 and my girlfriend has got self employed visa until October 2012, and we would like to get married and switch her visa to dependent Tier 1.

What do you suggest about the time of marriage and application?

When you should get married is your choice - is not relevant to immigration.

With regards to applying for EC, if your spouse applies for EC before March 2012, she will be issued leave until March 2012 and will have to apply for extension with you (extra money). So best that she applies only after you have been granted extension.

Also, she cannot switch - she will have to apply from outside UK

Hi,

Do you mean EC as entry clearance?

If that is the case, she is already in the UK having self employement visa, so she can switch into Tier 1 dependant with no problems right?

Yes

You need to read the guidance policy for dependants. She cannot switch in-country as mentioned by Sushmehta in a previous post that...

If she cannot switch what do you suggest as the course of action?
Shall I do as follows?
Renew my Tier 1 visa in March 2012, as soon as I get my visa, I will take my fiancee back to my home country, get married there, apply for EC while she still has self employed visa.
Is this feasible?
What happens if the dependant application gets rejected? Can she still come back to the UK with her existing visa?
If the application is approved what happens to the existing visa? Got cancelled?
I know I have asked too many questions but really appreciate your help.
