Hi,

I need some honest advice regarding my visa situation currently.

I am on PSW Tier-1 currently, with visa expiring in Jan 2012.
I am working full time for an electronics retailer with a customer facing sales supervisory role.
My annual salary is just under £22,000 before taxes.
My employer has a Tier-2 licence, and is looking to help me get the CoS.
I have been working with the same employer for nearly 15 months now.

I have become confused after reading the policy guidance.
The question is do I fulfill the Home Office requirements to get the CoS?

find the job in code of practice that matches your current job description.

ensure you get paid at least the 'APPROPRIATE SALARY'

ask your employer to issue you a COS

I am going through the Policy Guidance, and would like to confirm if this is how my application would be assessed:

Attributes (need 50 points):
- Assigned CoS having met the requirements of PSW (30 points) Page 15
- Appropriate Salary (20 points) Page 17

Para 97 (Page 19 in Guidance) states:
Switching from a post-study category
You can claim 30 points if you have a Certificate of Sponsorship and are switching from:

97. Tier 1: Post Study category; or Fresh Talent: Working in Scotland Scheme; or International Graduate Scheme (or its predecessor, the Science and Engineering Graduate Scheme);

AND

if you have worked for your sponsor for a continuous period of at least six months immediately before the date of your application. You must be applying to continue in the same job you are doing on the date of the application.

AND

if you are applying from inside the United Kingdom

did you manage to find a suitable job title/job code on code of practice.

do you satisfy salary limits

if you answered 'no' to any of the above question then there is no point in looking anywhere else for tier 2 based visa as you DO NOT satisfy the criteria

To the OP,

Buddy, is code 1142 not relevant to your job?

I think you could be classified as a customer care manager.

Have a look in Section N of codes of practice?
