Confused about 3rd party sponsor for spouse visa

Confused about 3rd party sponsor for spouse visa

Hi all

I have recently seen the consultation paper regarding changes to the spouse residency visa and debating if I should get my application in now or wait for the potential changes to take place.

I have been married to an Ecuadorian for the last 3 years and have lived in Ecuador since then and currently do so. I am thinking now of getting my application in for her spouse visa as soon as possible. However, this was never part of our long term plan as we originally thought we would try and come back to the UK for next summer. The problem being is I currently don't have any work lined up in the UK and worried about my changes of finding it in the current economic conditions. Also I hate the thought that I have to go back to the UK alone to look for a job and become "settled" without my wife with me. In addition, if I lived in the next few weeks or it really would feel like a gamble if I could find a suitable job in that time (i.e before the proposed new immigration laws come into place in April).

One option I have is 3rd party support - my Mother. She receives part of her government pension in addition of a regular income from a full time job of around 18k and no mortgage to pay on her 4 bedroom house. My question is, what are the conditions and income threshold for a 3rd party sponsor? Is it the same as the approx 105GBP per week as if I was to sponsor her?

I've scanned many posts and most people seem to suggest that the sponsor going back first and getting settled is the best option. If anyone has a similar case or knows the answer about the chances of having my visa approved purely by 3rd party family support id be very grateful.

Whilst 3rd party support from close relative is allowed,that does not mean that all the support should be funded by the family , which appears to be the case with you

Some financial help from family is allowed, providing the majority of it is from yourself. The onus is on you to prove that you will be able to support, maintain and accommodate your spouse with out recourse to public funds.

My advice would be for you to travel back to UK, stay with your mum, get a job so you are earning some money and then reapply for spouse. You can stay with your mum until you are in a position to find your own place to live.

I am afraid if you apply on the basis that your mum will support you and your wife on her pension and earnings, you will almost certainly be refused :wink:
