Hi! I'm married to an Austrian citizen and we have been living/working in Austria for a couple of years now. I have a family member visa (Aufenthaltstitel) here. My wife and i have considered moving somewhere within the EU and I would go to university.

I understood EU law to be that EU citizens and their family members can study at other EU universities and they would pay the same as citizens of that country. However, I can't find the direct law that states that.

I received an email from the University of Malta stating that I would have to pay tuition since I am not an EU citizen. Is that true? I could be confused about the process or I may have misunderstood. If anyone could direct me to the exact law, I'd really appreciate it!

You must be treated as if you were an EEA citizen (so long as your EEA spouse is with you and is exercising treaty rights).

Registration and tuition fees
You are entitled to have access to education under the very same conditions as nationals
(e.g. no registration or tuition fees if nationals do not have them, no numerical quotas for EU
citizens so EU countries cannot give preferential access to the education system to their own
nationals).

Thank you! I've been searching for something more official. I had read some things on the sites of other universities, i.e. UK and Sweden, but I hadn't found anything through the various EU sites.
