Hi

My wife moved to UK on 19th Dec, 2009 under Tier 1 Dependand. After I got PR I applied FLR(M) for her which is valid till 2013. I believe she is eligble for PR from 21/11/2011? I have appointment for 25/11/2011.

Question 1: Are my dates right?

Question 2: I am self employed and takes 1000£ as gross salary every month and takes profits as dividends. Do I need to show the dividends and company a/c statements or just the last 3 months salary and my personal bank statements? I have all P60s which shows the dividents and salary.

My wife also started working recently and got just 1 month salary certificate and bank statement.

Note: I got my Citizenship last month and had Passport interview recently and awaiting the passport.

Pls advice.

Your wife's current 2-year spouse visa, what is the start date on that, and also its expiry date?

Hi

We got married in Nov 2009.
she got first visa on 03/12/2009 valid till 29/01/2013 issued in Chennai, came to UK on 18/12/2009, visa type Tier 1 General Partner.

I got my PR last year so got transferred her visa to FLR(M)
13/08/2010 until 13/08/2012.

I believe 2 year starts from the date we came to UK? Pls advice.

My thought would be 2 years from 13.08.2010, but better check with the gurus.

So her spouse visa is valid :-
13/08/2010 until 13/08/2012.
That being the case her ILR application can be made no earlier than 28 days before the expiry date of the current 2-year spouse visa = 16.07.12 ..... and no later than the expiry date = 13.08.12.

That assumes, of course, that she has passed the Life in the UK Citizenship test.

Cancel the appointment scheduled for 2 days time.

I don't think FLR(M) has reset the period, she came here on Tier 1 Dependent, which counts towards ILR.

Does any one has UKBA contact no, so that I can call them and check.

Paragraph from the above link:
If you were given a visa in this category but you then delayed your travel to the UK by more than 3 months, you will need to apply using application form FLR(M) for a further probationary period of 2 years. If we give you a further probationary period and you meet all the other requirements for settlement (including the knowledge of language and life), you will be able to apply for settlement as soon as you have completed a total of 2 years' probation (adding together your time spent in the UK under your visa and the necessary number of months from your second probationary period).

So...
Which means we don't need to spend the whole 2 years of the extended visa, just the necessary number of months required to complete the 2 Years period from the date entered UK. So I can apply for my wife on this Friday.

Note: She has completed Life in UK test.

287(a)(i)(d) applies ..... so no earlier than 28 days before the 2nd anniversary of her entry in to UK as a dependant of Tier 1 (General) migrant.
