Extention granted confusion about work

Extention granted confusion about work

Hi members.
One of my friend applied for extention a couple of weeks show and today he got his documents back from the HO with a letter that his visa has been granted along with the latter in which terms and condition is written. In that letter it is mention that he can work 20 hrs and can not work as a self employed and no sources to publish funds etc. Latter on in afternoon time his Bio matrices card also arrived in which it is mentioned that no work allowed and no public resources.
So there is a concussion about the work can any competent member or moderator give his opinion regarding this matter

Please tell us type of visa applied and if it's T4, name of the Uni/College?

It would be easier if your friend posted himself as he is in a better position to explain his circumstances

When the passport is returned following a grant of tier 4 leave it comes with a letter addressed directly to the applicant, as well as a general informaion document setting out the conditions of leave for tier 4 students, however this general document listing what each of the work observations on the biometrics permit means - it is not individual to the applicant - it is a information document. It will state what the 10 hour grant means, what the 20 hour grant means, and that the no permission to work grant means. The actual covering letter addressed to the applicant with the passport does not list the person's permission to work. This letter will have the applicant's name and address on etc, as well as the course for which he was granted leave. The other letter stating the conditions of the grant (permission to work, no recourse to public funds, restrictions on changing sponsor etc), is not addressed to the applicant.

The biometric permit is the document which states whether or not a person is permitted to work and if so for how many hours per week,

At what college is your friend study and at what level is his course?

Thanks for your detailed reply. He got extention in Cromwell college. Corse type is diploma leading to Msc so got a 2 years and10 months extention. He has been in this country for 6 years as a student and two years as a visitor and there is no gab of 3 months during his stay as a visitor and as a student. Hopefully he will get indefinite leave to remain when his ten years will be complete. As there is mention in his BM card no work allowed so that means his NI is revoked.

Your friend is not eligible to work as Cromwell College is private college.

Plus you friend will not get ILR as visit visa period does not count towards 10 year ILR. So actually your friend is having 2 years gap between studies and new Tier-4 visa limitations, you cannot get ILR on Tier-4.

It does.

That said, how could the "friend" stay in UK for 2 years - lawfully - on a "visitor visa"?

Yes he can for six month and re enter after a couple of weeks again as a visitor. That's what he done as he got a 5 years multipal visa at that time so he use to enter for din month and then leave the country for a short time and again renter dose it makes sence

It does, but that is not same as "living in the UK for 2 years on a visitor visa" - a statement you made earlier.
That said, time spent in UK as a visitor will count towards settlement under long residence.

Sorry for taking the discussion off-topic, but thought it wise to ask and also clarify.
