Who looks at appeal?

Who looks at appeal?

My wife was refused entry clearance from Zimbabwe. We appealed and were told that the entry clearance officer would review his decision and perhaps overturn it.

On these forums some people have said that the ECO would look at them with his supervisor. However, the person I spoke to at the embassy said this was not the case. How then, can I be assured to get an objective account?

To the people that say the ECO would be with looking at it with someone else, where did you get this information?

When an appeal emmanates from a refusal decision of an ECO it goes to the AIT in UK, they then inform the ECO about the notice of appeal. The ECO then has the opportunity to revise his earlier decision which is done with his Line manager's guidance-the Entry Clearance Manager (ECM). At this stage the ECO could over-rule himself or stick with his earlier decision,next the ECO sends the AIT copies of the documents used in reaching the decision.If he stuck to his decision, the AIT will now inform you about it and ask you to make further representations in respect of the refused visa application.

Your Appeal will be sent to the AIT in the UK for regestration which takes about 2-3 weeks, once registered and a appeal number is issued the ECO at the british post you applied will review the appeal along with his manager (ECM) in case if he decides to over turn the decision he will then send you a letter appeal withdraw form (APP9) in workst case if he decides to stand by his decision he will then have about 78 working days to prepare a report on the same and then send it to the AIT after which the AIT Judge will look at your appeal if you have opted for a paper hearing the judge will make a decision based on the paper evidences you have given and if you have opted for a personal hearing then the sponsor will be given a hearing date and has to be attended by the representative or the sponsor.

the story does not end here.... if the AIT judge decides to make a decision in your favour he will then send a letter about his decision to you as a appealent, your repersentatiove or sponsor and to the ECO who made the decision.. after this the ECO will have 28 days to appeal against the decision and if he decides not to appeal you will be issued with a entry clearence after 28days from the date of the decision but if he decides to appeal you will be back to square one..
