duration of spouse visa and chances of approval

i have a 7 months baby and i am on a work permit status met my spouse in 2009 (British by birth) and got married on 12th may 2011 after waiting one year for COA submitted my documents through a solicitor on the 10 august 2011 and received an acknowlegement on 12th august and biometrics letter in the 18th submitted biometrics on 23rd August how long after biometrics do i have to wait and what are the chances of getting spouse visa

let me add on the company i was on work permit with went bankrupt and shut down last year in 2010

So what have you been doing since then?

In straightforward situations you can expect to wait six to eight weeks from the date of applying for a decision. What are the chances of being approved? Impossible to say; you have not given any relevant information of your circumstances other than you are bankrupt.

I guess the fee you paid your lawyer did not stretch to him imparting this information to you but he will know more about your chances as he knows everything about your application.

well, just simply put as i am on work permit status got married to my British spouse on 12th May 2011 and have a seven month old son i have submitted the documents on 10th August 2011 and already given my biometrics on 23rd August

when my company got shut down in july 2010, my application was with HO for Certificate of Approval so there was no need and as soon as i got my COA i married the week after so there was no need to inform

Hmm ..... you delete the relevant part of your first post, and expect my question will go away. It hasn't .... please answer, if you want to get answers about the chance of getting a spouse visa.

From the very little you have stated you have been overstaying your visa in the UK for about a year (since your WP was voided when the sponsor ceased trading). I hope your lawyer told you that this situation has no chance of an application within the immigration rules. However, with a British wife and child, you do have a chance of being granted discretionary leave outside the rules.

Discretionary Leave granted outside of the Rules is likely to be a long process.

Discretionary leave will still imply even tho my work permit is valid till december 2012

If the company closed a year ago your current leave is no longer valid. I think asking your solicitor would be more appropriate as he knows all the details of your case. Comments here are generalized based on your scant information.

Received a letter from HO on 6th September asking a few more details which include a tenancy agreement, latest council tax bill, last six months salary slips and a letter from employer, as per my previous messages I informed that my company has closed down so providing salary slips is out of question. But I have applied for another job, from which I have received a reply and that company is willing to offer me a job, if I get permission to work or in my case get the spouse visa.

I was wondering that If I send them that offer letter would that hold any leverage to cover me, as I think all they want to establish is that I won't be claiming public funds and can support myself.

I have the other documents what they asked for that is the council tax bill and tenancy agreement.

Any suggestion or advise would be highly appreciated.

You have told us you "submitted my documents through a solicitor on the 10 august 2011", so what does your solicitor say in answer to your questions?

i had a hearing on the 4th November, and received a reply on the 23rd November that my appeal has been granted.
the Home Office however is given 5 days to appeal against the judge's decision and the letter is dated 21st November 2011.

Just wanted to know, whats the next procedure after the appeal has been approved, the home office has not countered appeal the decision.

It's been more than 2 weeks and no reply from home office yet, my passport is already with Home Office and biometrics were already done.

just a quick update for people who are waiting to hear about their successful appeals

i spoke to the appeals implementation unit, they have advised me that they now are dealing with appeals which were heard in november 2011, anybody whose appeals were heard in november 2011 can expect reply soon.

there is no central appeals implementation unit anymore, and even if there was UKBA depts do not always deal with things in an orderly fashion, so it's nto realy safe to say that anyone who had an appeal heard in Nov 2011 will expect a reply soon.
