However, you are well over their three week timeline. It should not have taken this long. You are entitled to a free, facilitated visa. It must be issued as soon as possible. Have you complained? While they may refuse the visa, you are still entitled to a quick decision.
If there is an emergency, you would be entitled to a very fast turnaround.

Don't lose sight of the fact that your visa should be issued as a priority, ie ahead of all those tourists, business people, olympyans, financial investors and their friends.siv123 wrote:I sent a complaint online through Worldbridge Services 3 days ago. No reply so far. The last reply from embassy on my email enquiry was 10 days ago. Decision taken, but it is still under review. According to embassy it is standard procedure to review decisions before they are sent to applicants.
Now the problem is that we need to travel pretty soon and can't afford more delays.

Also use http://www.ukba.homeoffice.gov.uk/about ... complaint/ to complain (today) about the fact that your visa application is being processed so slowly. They are legally required to give you application priority.

Directive/2004/38/EC wrote:You have complained to the embassy. Have you also complained to UKBA centrally at the web site I sent you?
They are legally required to issue the visa "as soon as possible and on the basis of an accelerated process".
Directive/2004/38/EC wrote:Contact the embassy. Ask for the documents back now, but say you wish to continue with the application.
Where is the problem?
The ONLY option for refusing the application is those grounds in (5) or if it is a fraudulent marriage. No other options exist for them to refuse.Issue of EEA family permit
12.—(1) An entry clearance officer must issue an EEA family permit to a person who applies for one if the person is a family member of an EEA national and—
(a)the EEA national—
(i)is residing in the UK in accordance with these Regulations; or
(ii)will be travelling to the United Kingdom within six months of the date of the application and will be an EEA national residing in the United Kingdom in accordance with these Regulations on arrival in the United Kingdom; and
(b) the family member will be accompanying the EEA national to the United Kingdom or joining the EEA national there

(4) An EEA family permit issued under this regulation shall be issued free of charge and as soon as possible.
(5) But an EEA family permit shall not be issued under this regulation if the applicant or the EEA national concerned falls to be excluded from the United Kingdom on grounds of public policy, public security or public health in accordance with regulation 21.
Directive/2004/38/EC wrote:I would hope they would give you the passport back. I would be very explicit that you need it to travel, but that you would like to continue the application. Ask them the reason for the delay. They might even issue the EEA FP there.
Be very patient and very firm. I would personally refuse to leave until a British visa officer sees you. Be sure to get the person's name!

We just simply rang the embassy and they asked us to pick the passport the next day!! Although now the passport has two stamps from the embassy.
