what if a baby is born to my same-gender partner

what will be his immigration status? since we are not a husband and wife and my partner will be pregnant through insemination. will it still considered as our dependent? i am asking this since i've heard that childbirth through surrogacy (for my gay men friends) is not an option until they receive their ILR..Please help!
