hi guys great forum
i am on student tier 4 on bba and was granted a visa until oct/2012 but i have finished my course in september/2011. i am now applying for PSW but i have exceeded the 60 days limit. this was because of my passport renewel. it took some extra time due to which i got 20 days exceeded.
i know that i can apply for psw within 12 months but i am currently on student visa and in tier 4 guidance it says that i have 60 days to take next step.
i am reallly sterssed guys i dont know what is the options.
i really need some help. i can get the letter from the embassy saying that because of thier system error my passport got late but do u guys think that i should mention this to the home office or wait for the decision and then go through solicitor.

did ukba or your uni notify you of curtailing your visa to 60 days?

if not, then you still have 4 months (from sept '11) to pack up or make a new application.

i am sorry i didnt get that
how would they have notified me and what should they notify me because i had a grad ceremony after two weeks of my results
does that mean they have notified me

unless ukba or your uni notify you, in writing, that they are "curtailing your visa to 60 days"....your visa is NOT curtailed!

this means limit of 60 days etc. doesnt apply to you

which means you can make psw application anytime before April 2012

PS ignore what i said earlier about 4 months.. as it appears they have updated stuff...

ya man but this doesnt say that they have to notify me in writing which might makes it our own responsibility to look after it which can cause problem

and the second thing is that when i am applying for psw are they not going to focus more on the verfication of psw then my old visa conditions

if you get biomatric appoinmnt letter does it mean good news or still hunged up
it means your application is making progress. its likely caseworker still hasnt seen your app though so you cant say anything about the outcome of your app[/quote]

also, one of the checks that are made when assessing new app is if applicant breached immig rules anytime in his/her previous stay in uk.

if yes, then you get a refusal thanks to para 320 'general grounds of refusal'

so it means that i might have a chance of refusal

because apart from this i never have breached any other rule

lets assume:

you were awarded degree on 20 September

you were suppose to leave uk on/before 20 Nov, due to this 60-day rule

but you didnt.

so you are an overstayer since 20 Nov.

you can make 'out of time' application provided you have not overstayed for more than 28 days

that means you have until 18 Dec to make a psw app and still be considered for this psw app

if you satisfy all the requirements, you will get your psw.


i dont know why i bothered with that make-believe scenario... cuz you are alright as noone has curtailed your visa in first place... but ho hum

if that is the case then i am in right place because i am aplying on 12 december and yes the degree was awarded on 21/septemeber
so i guess and hope that i will be in time
