Hi all,

I have recently been granted ILR after working in UK for 4 years. I am living here with my spouse & kids. My mother was living in Pakistan with my father, who passed away some time ago. My mother is 60+, patient of normal old age diseases and is almost helpless there. Though she has few brothers and sisters there but they are not much willing to take hers’ full time responsibility.

I will appreciate if members of this forum could guide me on how I can arrange for her permanent residence with me in UK as my dependent. She came to UK as a visitor 3-4 times during last 4 years. Initially she was given 6 months visa, then she got 2 years multiple and now she has been given 5 years multiple, but of course visit visa. Some one told me to file a case on compassionate grounds. Can you please put some flesh on the bones? If there is a way out, usually what is the success rate (for a case with these circumstances) and what is average time frame involved?

The rule of thumb is that a parent should be 65 and over; without other relatives to turn for help; and that you (the sponsor) are able to accomodate her. Since she is below 65, has relatives in the country (at least formally speaking), and perhaps has health conditions that may complicate her getting entry clearance - perhaps you'd like to turn to a lawyer who will personally supervise the case from A to Z. I believe chances are good, it just needs to be done convincingly and conclusively.

the above topic has been covered extensively on this forum - so do some legwork and search for answers on the forum. It is possible to get your to the UK as a depedant...

I dived into different sections of forum and into the posts from Dip as well. I could find one case of NDA that was discussed in much detail with generous information and input from Dip, Kaya, tdabash and Chess.

I have no problem receiving a pm from you - however the topic on/by NDA covers more or less all the grounds that need to be considered. Unless your situation differs fundamentally from his then expect a similar response.

I am in a similar situation. My mum who is 65,is now here, in UK, on visitor's visa and wants to go back in 2 months time. I spoke to an immigation lawyer and he said it is better to apply while she is here(apparently not in home country!). So he has advised me to approach him when she comes back next time. He thinks it will be better if I keep sending £100 often to prove she is financially dependant on me. I hope this helps

While going through the posts of different forums and of different cases, I got the feeling that cases submitted for change of status while in the UK are mostly denied by the IND (I might be wrong) and when case is re submitted from the home country, it faces complications. My sincere advice would be to (i) seek further advices from the experts on this forum (ii) take a second opinion from another lawyer (iii) Try to consult with some other members who had similar cases or have been advising on similar cases (like Kayalami, Dip, tdabash, NDA etc). Advice from your current lawyer is genuine, as it will certainly strengthen your case.
