10 years long residency..

Hello all
Application Sent: 15th Aug 2011
Received All the paper back :15th Nov 2011

Got all my paper back today but no ILR Stamp cause when i came in UK in 2001 I had a Visa till 31st Oct 2003, So when i applied before 31 oct 2003 i filled the wrong form and they asked me to send the new form which i did but it was after 31 oct 2003 and when they gave me Visa it was 5th Jan 2004. Now they are saying that I had a gap since 31 oct 2003 till 4th Jan 2004, so they do not consider as 10 years lawful. SO i am not going to apply just thinking about leaving the country before my Visa expires in Jan 2012.

Anyway Best of Luck for those who are waiting.

When did you send a valid application after Oct 2003?

I believe there is a discretion on the caseworker in cases like yours to grant ILR.

When does your current visa expires? Have you any other basis to stay in the UK? Did they give you any right of Appeal?

Vinny, similar provision seem to be in the 2007 regulations, which i think repealed the 2003 regulations, or am i missing something.
