how much are u paying the lawyer so we get a rough idea and also what papers did u send to court and respondent, the same ones you sent for appeal?

Hi all,

I've just read on the UKBA website that from the 19th December they will start charging a fee for appeals! Unbelievable! And you will only be able to appeal in the UK not at the embassy in another country! No news on the actual fee until 19th so if anyone is just about to appeal, I suggest you hurry up and do it now!

We appealed mid October and still have not heard anything except the confirmation that they have received it. They also somehow made spelling mistakes on the letter despite the fact that what we sent was absolutely correct. Double check all your details are correct if you're appealing.

Ya i sent all recent documents to court..... Recent payslips, bank statement, evidence of keeping in contact regularly etc....

Apparently this is on top of any solicitor you employ. This is a fee directly to UKBA (or Ministry of Justice) to appeal in the first place.

Can't believe how much it all costs!

can you not just start a new application for the visa, costs around £1000 for the settlement visa, why pay a solicitor and UKBA £1000+ and wait 4 months?

So far, the appeal is free. If you hire a solicitor to help submit the appeal that's up to you and an additional cost. If the decision is not overturned, you go to a court hearing. Again, I believe this is free. If you hire a solicitor to represent you that's additional again and completely up to you.

So it depends on personal circumstances how much you are willing to pay but effectively, assuming you don't hire a solicitor at all, the appeal is free. Well, until the 19th December. And you can either find a budget solicitor (as we have as we lack funds for such things on top of life in general) or hire an expensive one - again that's up to you.

Or apply again - you are right.

Who knows what the best option is for your individual circumstance. Especially when they refuse you on silly reasons and misunderstandings which merely show their lack of understanding of British life!

I can't believe they are going to charge us for the appeals! My Appeal hearing date is on the 30th January so I won't have to pay anything. The whole process is expensive and they are making it worse for us. On one hand we need to show that were financially capable of supporting our partners and then They chuck all these charges at us!

Sorry for shouting but I had to make myself feel better!!

Looks like appeal fees are now £80 or £140 depending on paper or oral appeal for appeals against decisions made from 19th December onwards. Details on Ministry of Justice website.

My appeal went good.... Several questions asked by Home Office to my wife and her boss... Everything went smoothly... Barrister said we should win it easily... now another wait for determination latter.... Hope it does not delay due to Christmas and new year.... thanks for all ur support guys.... I appreciate it and best luck to all.....

Guys , i mailed BHC in india last week and got this response this morning, thought i'l share , theres no point chasing BHC or tribunal, they will look at it whenever the time comes--


Dear Sir,

This is with reference to your email below.

Request you to await the decision on your appeal application as it is under process. Please note the appeal process is a lengthy one. Presently your appeal papers are with the High Commission and we will process your appeal file in due course and forward it to the Asylum & Immigration Tribunal in the UK.

Hey ejaz, I am so glad that your appeal hearing went well. I hope you get your decision letter quickly! Not long to wait now! I have my hearing on the 30th January. Not too long for me to wait now so I'm really nervous!

I have received a phone call from BHC to come with my passport for an interview next week...has anyone come across anyone on this board who has appealed and then called for interview?
