Congratulations to you Lcity. Your success has given us hope and the drive to continue to regularise our stay. Please when did you arrive to the UK and also what documents did you send to them? I have read the previous posts but I believe a new post by you now that you are "free" will be more informative etc. Thank you.

Hi there,
I came to the UK 1997 to study. I stayed lawfully until 2005. After that I started straggling and then I was un able to renew my visa until this year when I applied.I sent everything to prove that I had been in this country all along. Gp's letter, payslips from 2004-2011, a letter from HMCR proving I had been here and paying tax from 1998-2004,p60s from 2005-2011,employers reference which proved I had been working for them for 10 years, employment contracts for this period, all my certificates that I have
obtained in this country when I was studying, bank statement to show that my account was active, a letter from the banks confirming that I have been with then since 1998 and personal statement of why I consider the UK as my home and of course a good representation from my lawyer. If you have been paying council tax you can send that, basically all correspondence in your name and addresses that you have lived
I hope this is of help to all, keep fighting!! All the best.
Lcity.

I got my stuff back.I was denied on ILR but have been granted 3 years discretionary Leave to Remain. It is good news for me as I am legal. UKBA state that there had been a removal notice in 2007 hence the reason to deny ILR.

Hi KID DXL,
Thanks for mentioning that 'UKBA state that there had been a removal notice in 2007 hence the reason to deny ILR'.

I came to UK in 98 on student visa and stayed lawfully till 2007. Unfortunately, my very last extension at 2007 was refused and i was given removal instructions. My 7-8 months were wasted contacting HO to reconsider my application via solicitor but attempts were gone in vain. Finally, changed my solicitor, applied for DL 2008 and got that accepted in 2010 for 3 years.

Now, its been 14 years. My current DL is expiring next year. I have been lawful and unlawful (which i think now means, overstayers only, excluding refused/rejected with removal instructions? isn't it???). Can i apply for ILR now???

I was granted DLR because my partner is british and we are due to get married this year. I did not know about the removal notice until I got this application back so there was nothing I could do about the notice. The UKBA have said that the removal notice stopped the clock in 2007 so I do not have 14 years. Other than that, I had a strong application as I have benn working continously for 7 years in a professional company and produced alot of evidence on all points of the application.

Hi Kid DXL,
Congratulation on being granted your DLR. This is good news as you are now in this country legally and in time when you marry your partner you can apply for spousal visa and eventually become a British citizen. Enjoy your freedom.

Here is my full response from UKBA.
ILR - Refused as it is considered that despite being in the UK for over 14 years that I did not qualify for ILR as there had been a form IS151A (notice that you are an illegal entrant or you are subject to removal) issued in 2007. This caused that clock to stop at almost ten years. They granted Limited leave to remain for 3 years due to Article 8 right to family life. This means I can live and work in the UK legally but I have to reapply for ILR again.

yeah, you are right. in 2 months it will be 14 years but i will not be able to apply for ILR because my clock was stopped at 2007 (with removal instructions) even though i was granted DLR on 2010. I have to now wait until i finish the initial 3yrs + 3yrs of extension of DLR to become eligible to apply for ILR or unless i marry to british citizen isn't it? are there any other ways for me? :'-/

I have been following this thread with interest over the last year and it’s been an invaluable resource of information and advise. The success stories here have given me hope and the resolve to try and regularize my own stay.

I recently put in my own application for ILR under the 14-year policy via a solicitor…here is my timeline so far

Application sent: 22/02/12
Application received by UKBA: 24/02/12
Acknowledgement letter dated: 24/02/12
Account debited: 24/02/12
Status: waiting and praying...

I got my 14 yr ILR! My lawyer contacted me with the good news. However, I couldn't quite believe it until I actually saw the stamp in my passport.

I've been following this forum for the past couple of years and it's one of the things that's kept me from losing hope. Thanks to all those who have shared their stories and timelines.

Here's my timeline.

Application sent: 19/10/11
Acknowledgement letter dated: 21/10/11
Payment by bankers draft
ILR stamped: 10/02/12
Documents received by my solicitor: 21/02/12

Good luck to all of you who are still waiting! I'll be keeping an eye on this forum as I've got a friend who'll be applying for their ILR soon, so if anyone has any questions or would like more details please feel free to ask.
