refusal of entry clearance

Post by thuggy » Tue Dec 20, 2011 2:23 pm

hello everyone spouse visa got refused today.

The Decision
you provided a city and guilds certificate (spoken) which you have passed, but you have not provided a certificate for listening. therefore you have not met the requirements of paragraph 281(i)a(ii).

somehow my cousin who was sorting paper work out for my wife forgot to include the certificate for the listening part.

can anyone tell me whats the next step from here is it straight forward we have the certificate for the listning part. many thanks

If you send it in with the appeal, hopefully the ECM review will catch this without the need for a hearing in the UK.

as long as the certificate was obtained before the date of your initial application.

If you did the listening one afterwards or it's randomly dated afterwards, apply all over again or you'll only get refused at the appeal as it will count as 'new evidence produced after the inital application' and they don't like that, no matter the quality or necessity of it.

To get the decision overturned in light of additional evidence, you're looking at a wait of 6-7 months, and if it hasn't been overturned you go to a court hearing.

We appealed in October and are STILL waiting.....

And when did the appellant get the Refusal Notice itself, because there is a time limit on appealing against the decision.
