Post by fraternisation » Thu Nov 03, 2011 1:57 pm

Hi all,

I have been married to my wife for about 2 years now and she is coming towards the end of her visa. We are in doubt regarding the relationship and we would like to extend the visa and not have ILR (extend the probationary period) Can you please help me to find some directions such as when to apply, what form should be used etcccc?

You can apply for ILR at any time during the extension.

i don't quite understand you are happy to apply for further leave but not for indefinite leave - in both applications you have to confirm that the relationship is subsisting and you intend to live together permanently?

the information is easily accessible on the UKBA website under partners and families.

You have no power to 'cancel' your wife's visa. It is up to the UKBA whether they choose to curtail her leave.

i am not authorised to cancel it i know that but to stay legally on the right it is my right to inform them about the termination of the relationship from that point onwards it is up to them to give her a visa/not give her or even make her a queen as long as i dont have her in my house or with me

If your wife's nationality requires her to enter the Netherlands on a visa, then she will still need to apply for a Schengen visa, even if she is travelling with you. Did you have a plan to inform the UKBA of the breakdown of your marriage, take her to the Netherlands and then hope she'll be refused entry back into the UK?

well it was clear anyway and six on two threes. if i took her there or infomed the ukba here it wont make much difference as she only has few three weeks left in the visa. when the visa expires and i dont renew it what then? do i still have to be her santa clause????

It seems you are still together if you want to take her to the Netherlands. Is she aware that you believe your marriage has broken down and are not willing to support the application for ILR?

She would need your support to apply for ILR and you would need to sign the form.

I don't think it would be right for a person to take their spouse to another country, abandon their spouse and then manipulate the system so that the spouse cannot return home. Pretty scumbag behaviour IMHO.

well she is aware of what is going on of course as i am not living alone and this partnership does not work and we both aware of it. If you think I am morally corrupt that is not punishable by law I am afraid. If you think I am manipulating the system to get her out of her then the people working on the system should identify any wrong doing and punish whoever committed a criminal act. Your are looking at the story from one side and by the way the trip to Amsterdam was cancelled as we could not board the plane due to visa issues. My other option now is not to support the application and inform the home office that the relationship is terminated. Is that still playing the system or do you want me to sign an application and say I am happy for the marriage to go on where in reality it is the opposite?
