1. U need to start the appeal process to be a legal resident in UK.thanhtu1255 wrote:I have just received a visa rejection from UKBA because of bank statement issue. They said that closing balance of my bank statement is dated more than one month before the date of my application. More details, my closing balance is 6th september but i submited it in 24th october. I really didnt know about this rule. I mean the Tier 4 office at my university didn't check it properly. Now i am so confused. I have some following questions
I really want to appeal because of saving money. But it seems to take too long so I decide to re-apply in person. But my current leave was expired by 31st october so Am I allowed to re-apply ? Anyone has been through this issue? Please recommend me the quickest way to sort. Thank you very much
2012 I am afraid you are incorrect on the points above.2012 wrote:
2. If you apply again more likely your application will be refused as you do not have a valid leave and will be considered illegal.
5. If you can provide the bank statements and convince the immigration judge that uni made the mistake while checking your application and now you can provide the evidence for maintenance.
7. I amsure if you do that u can win the appeal
Your university advisor is advising you to reapply because your appeal is most unlikely to suceed for the reasons explained above.thanhtu1255 wrote:Thank you very much for your reply. My tier 4 advisor recommend me to re-apply and make a fresh application with a fresh bank statement (wth ? why? )
Actually, I dont really trust her. She said I can provide the ukba my old bank statement and new bank statement to prove that from 6th september( closing balance) until now I havent spent any money.
thanhtu1255 is a student at university it is fair to assume he has a brain and can read. No point blaming the university advisor all applicants should know the rules and requirements before applying for a visa etc After all it is the applicant who signs the form not the advisor.2012 wrote:Exceptional circumstances shud be used to persue the appeal as it was mainly a mistake by the uni.
