Chimpee I am eagerly waiting to hear about the result of your case as i will be applying for my husband's visa this month... i am in a similar situation to you as my husband overstayed and was working illegally too. So really worried if his visa will be rejected too :( Hoping you receive good news to give me some hope too! :) Good luck.

I am still awaiting any news from our appeal. We appealed in mid October and apart from the acknowledgement, we have received nothing.

We feel so drained of hope. It's so unfair how cruel these procedures can be. If they actually followed their own rules we wouldn't have been refused at all!

None from me. I'm in the process of investigating solicitors in case it reaches hearing stage (current solicitor lacks abilty to reply on time, as agreed, or at all sometimes and it's extremely annoying - beware cheap and affordable but absolutely useless solicitors!)

Hi All,
Just went through all the 33 pages... and now I am feeling a bit scared. My case is also slightly complicated and haven't been able to get any answers. Would be helpful if any of you can share your thoughts..

My spouse stayed with me as a dependent for approx 2 years in the Uk while I was on HSMP. Due to personal circumstances he went to india, but meanwhile my status changed to UK Citizen and his visa expired. Now he is about to apply for a dependent visa again. we have got lots of conversation evidence (phone, email..) during that period. I have got a permanent job, flat, finance etc.

Do you guys think I should contact a solicitor ?

Sorry I should have typed more accurately. He is going to apply as "Spouse(Husband) of a british citizen" form VAF4a.

I am still not sure whether he can apply for ILR as he has already stayed UK for 2 years. Although there is a huge gap now.

Form VAF4a is indeed the correct form.

Yes, I had less hope about indefinite leaves cos he has yet to give the life in the Uk test as well. Do you think its a complex case and needs a private legal advice ?

Thanks John, thats a bit of relief to my mind.
I am going to solicitor tomorrow for certifying the copy of my british passport before i send it to my spouse. Will I need to certify all the pages (all are blank except the one with photo)?

I have done the same thing as well and I am applying in the first or second week of February as well.

I have certified my photo/biography page of the passport.

Also I have just got colour printouts of my previous visa stamps to prove my visits, but I have not certified these copies as I am using them only to show that I travelled in my communication section of the documents.

March 2014 - ILR Granted
Apr 2015 - Applied for Naturalisation
Nov 2015 - Naturalised

How is your partner showing english requirements?
Think mine would be applying in feb as well. Since he will need to apply for NARIC. And ofcourse two certi. 1) comparison of degree 2) medium of instruction as english.

For your case - you will need a letter from the Uni as well stating the course was English Medium and if you can get NARIC Certificate that would be great as well.

He can get the letter from university..does that mean NARIC certificates are not compulsory? do you know anyone who applied without one (just letters from uni).

i got response from BHC that they are still await their copy of determination... Can any1 plz tell me is there any way we can ask UKBA weather they have sent determination to Mumbai BHC or not? Plz can any1 provide me e-mail address?

Hi Ejaz,

I would directly email the hearing centre as they would be aware of when the letter was sent as they would have been the ones that originally communicated this to your solicitor..

Where did your wife attend the hearing??

Hearing was in Manchester but i read in determination that they already have issued copy to UKBA in London now its upto UKBA when they send a copy to Mumbai BHC... UKBA has 5 working days to appeal against judge decision and if they decide not to appeal than they send determination to Mumbai BHC....

This is what the website says..

"If your appeal is successful

If the judge allows your appeal, his or her determination will be sent to the relevant visa section, which will in turn contact you.

It can take up to 4 weeks for determinations to reach the relevant visa section, and a further 8 weeks for them to be processed. The visa section will write to you using the contact details provided on your appeal form IAFT-2.

Please do not contact the visa section until 12 weeks after the date when you or your representative received the judge's decision. This date will be stated on your written determination."

Maybe you have to wait a little bit more Ejaz.. Was there no email address or contact details on the determanition letter??

When i mailed to tribunal they said

Please note that due to procedural rules the Entry Clearance Officer is only able to accept determinations issued to them by the Home Office UK Border Agency. They are unable to accept determinations from HM Courts and Tribunals Service or directly from the appellant.
