ILR - More than 180 absence & One Visa issued from India

Post by sujeetp » Mon Jan 09, 2012 9:59 pm

Hello,
Need urgent help related to ILR application. I came UK on 18th Feb 2007, and planning to apply for ILR on 25th Jan 2012.
My Visas:
Work Permit valid till 01/01/2009
Work permit Extension valid till 01/01/2010
Tier 2 Compay Transfer valid till 08/01/2012 (Issued in India, while I was there for sometime)
Tier 1 valid till 19/04/2013
I have around 225 days outside UK. Out of these 225 days, 90 days were business trip (I have company letter to support this), Rest 135 are vacation / work in India (Max single trip 65 days). Can you please let me know if there are any issue with more than 180 days absence and my Tier 2 issued from India. Thanks.

As long as you can justify the days (which are over 180) and have the evidence that it was a business trip and you were paid by a UK employer during that time, you should be fine.

Hi Sujeet,
Check with Mods or experienced members, as I doubt your residency might be broken. as per ILR rules you should be in country continuously.
In your case it seems one of your WP was issued in India. Double check with a specialist Immigration Lawyer or helpful mods like Sushdmehata, Casa etc.,
I am not trying to demotivate you but you will be paying lot of money for your application, therefore it's worth checking all the eligibility criteria.

All the best,
chrams

Require Help on ILR

Post by pboopa » Tue Jan 17, 2012 10:21 pm

Hi Sujeet,

I have similar problem. I entered UK in 2007 through WP and returned back to India some time in 2009. I had to stay there for 2 months (some company policy) and returned backed with a new WP (Intra Company Transfer visa) in the same year. Later I switched to Tier1 General on Dec-2009.

I am eligible to apply for ILR by sep 2012. I have stayed outside UK for 191 days (includes 163 days vacation / holiday and 28 days - Business Trip). I understand from your message that you were going to apply for ILR in Jan this year.

I hope you have sucessfully got your visa. Could you please throw some light and let me know if you moved your case through some solicitor.
I appreciate your help.

Thanks
