I have been in the UK for 5 year continuous period with following exceptions on Tier 1 visa(2yrs HSMP + 3yrs Tier 1)

1. Got Entry Clearance on 27th Jun 2007
Entered into UK on 9th Auguest 2007
Tier1 visa expires on 27th Jun 2012
I have gap of 45 days between entry clearnace and port of entry. Shall i consider go for the PR. Or do i need go for the extn tier 1 visa.

2. One year i took holidays more then permited with loss of pay for 15 days. Does it matter. Rule say about it.

Do i need to go for the PR or extn of Tier1.
Looking forward for your suggestions.

As long as the gap between your entry clearance and UK arrival date is less than 90 days, you should be ok (The case workers have the discretion to consider entry clearance date for the purpose of 5 years continues residence).

You can’t be out of country for more than 180 days in 5 years time.

Your Tier-1 visa is ending on 27th Jun 2012, so you should apply for ILR before 27th Jun 2012. Don’t apply in too much advance.

Bhushan, I am in the same situation( entry after 72 days of hsmp visa issue)

I spoke to UKBA customer care, any thing less than three months should be fine.

Did anybody who were in the same situation applied for ILR ?

Y'day i called home office, they said it is OK to apply. He said we need to mention in the covering letter about it and they may consider it.

Hi,
While reading this thread, I checked my passport and realised that the stamp on the entry clearance is dated 15th May 2007.
I received entry clearance and date on it 22nd March 2007.
I travelled into the UK on the 27th March 2007 (but my dependant visa was still valid until 22nd December 2007)
I was on holiday to Turkey from the 7th May and arrived back into the UK on the 15th May 2007.
I think this is when they stamp it.....
I was expecting to apply for Ilr 22nd February 2012, but now worried about this.... Can someone kindly advice please.
