DISCRETIONARY LEAVE TO REMAIN for mexican?

Hi i need advice, i dont know what to do. First of all as mexican we dont need visa for come as a tourist to England.
1. I came in 2009 to meet a guy i met on internet, we flew back to Mexico after 6 months i was pregnant, so we came to England to have the baby ( as a tourist never ask for a spouse visa or nothing ) by that time they give me national insurance number which i never ask for but they gave me one, so i left the country after 6 months and then we been in and out, never overstayed or worked in England.
My partner and my daughter are british, so now i've been here for almost 6 months and i dont want to overstay but i have no intention to go back Mexico until march for just 3 months so the problem now is if i go to another country like FRANCE OR SPAIN for like a week or two when i comeback will they let me in or not?? They never really ask me that many questions in Border control.

Can i ask for a Discretionary Leave to Remain will that take too long?
Or should i apply for a spouse visa in Mexico, but will the national insurance number be negative... ADVICE PLEASE... :wink:
