Can i apply Tier 2 (ICT) ?

Hi

I had a Tier 2 ICT Visa which expired in May 2011. Now (in Jan 2012) my company wants to apply Tier 2 ICT Visa again.

New rules from October 2011 says that there has to be a cooling period of 12 months before one can re-apply for Tier 2 visa after the old Tier 2 Visa expires. I want to know does this rule apply to me since my old visa expired before this rule came into effect?
