ILR SET(M) help required..

Hi everyone this is my first ever post on this forum..I have seen some very useful advice given and was wondering if someone could help me out.

My husband is from Pakistan. He was issued his visa on 25-11-2009. He came to UK on 28-12-2009. His 27 month visa which he was granted is due to expire on 25-02-12.

What I wanted to kno was after having a read through about the application I found out that he has to have spent a minimum of 2 years in UK to be eligible for ILR, and that he is allowed to apply a minimum of 28 days before his visa expires.

Now there is a slight problem me and my husband went to Pakistan for 6 weeks between 29-09-2011 till 12-11-2011. I am a little worried as to whether he is okay to apply for indefinite leave to remain or will he need to apply for extension before he can actually b granted ILR.

If he is okay to apply what date would b convenient to make the application? Also we r thinking about applying in person at Liverpool or Sheffield office, can anyone plz share there experience if they made an application in person.

Also my husband has been employed since January 2010 and is still in the same employment, whereas I am unemployed and we r living at my parents house. So what documents will we need to submit with our application? If someone can plz help me out..I would b very thankful.

That time outside the UK is totally OK. He needs to make the ILR application no later than the expiry date of his current spouse visa.

Presumably he has already passed the Life in the UK Citizenship test?

Evidence to supply with the application? Have a good read of the form SET(M).

Thanks for the reply..the only letters we have are from our driving licence..nhs, mobile phone contract, bank statements which are all named as individuals and tax credits which are jointly on both our names. Would those b enough for the evidence. Also on the form SET(M) it mentions these letters need to cover the whole of the 2 years..so I am not quite sure about this. I have letters with the following dates will they b eligible?

NHS - 29-06-2010, 06-12-2011
bank statement - 07-05-2010, 07-06-2010, 06-08-2010, 07-09-2010,
Kirklees council speed awareness letter- 07-02-2011

Home office passport appointment letter - 03-08-2011
Nhs tax credit certificate - 23-05-2011
Outfit cardholder letter
Tax credit award - 20-12-2010 (joint names)
Child benefit letter - 12-11-2010

The documents listed above are the only documents we have as we r living with parents so don't pay any bills, mortgage etc. Can u plz look at the dates off the letters and guide me. Thanks

Why are the dates of the bank statements so limited? And is there no other documentation available? For example a letter addressed to you from your GP?

The form SET(M) does list lots of possible types of documents.

I can put in a request at the bank for some more statements but which dates should I ask for..also can u plz advice me into which letter I need from GP?

I have had a look at set(m) but we don't have any electricity/gas/water etc bills on our name sine we r living free of charge with my parents. Same goes for council tax bills so what other letters can we provide??

He qualifies to register on the voters registration roll. Is he on it? that could prove residence as letter.

Letter from parents confirming the facts you stated could prove useful too.

Yes he is registered for voting but where can I get a letter for that from? Yes thanks will also get a letter from parents. How many months bank statement do u recommend?

He hasn't already passed his life in the UK test..is still practising but will have it done within the next 2 weeks hopefully..

If he is registered to vote on the Electoral Role he should have received a notification from the council confirming this. How did he apply? In writing or on-line?

He applied in writing..but can't find the letter anywhere now

is there anyway I can get another one now?

I've rang the council and asked for a letter they said they will send another one out to say he is registered on the electoral roll. Also rang the GP..they will do me a letter stating when he registered with the GP..

But what about you? You have proof that you are on the electoral roll, and registered with the GP?

The idea is to prove that the two of you live together!

Furthermore, it will be no use if the evidence shows he is just registering now or in the recent past, evidence of historical registration will be more helpful. The evidence would be useful if it covers the most part of his residence, and also as John correctly stated without evidence of your registration it will be no use whatsoever.

I am on the electoral roll but I have no proof..I will ring them up and ask to send me a letter..same again with GP will ask them for a letter aswel.

After speaking to the electoral roll office today they said they will send a letter out which will show he has been on the electoral roll since 2010 and it will cover both 2010/2011 so that will state 2 years.

Can someone plz help me with the bank statements..how many do we need for each of us?

Well basically the idea is to show and prove that you and your husband have been living together for the probationary duration of 2 years so in order to full fill this requirement (which is a basic need to be granted ILR) you have got to show documents covering a period of two years these documents could possibly include any letters from the NHS,HMRC,TV Licencing,Council tax,water,electric and gas,Bank statements,tenancy agreements,government gateway letter,mortgage statements any other letter from council etc.

Right if you have bank statements lets say for the first quarter of you and your husband's joint account or in individual names then it would be enough to show that you lived together in the first quarter(4 months- jan,feb,march,april) of the first year of his visa and then you have to prove it for the second quarter(another 4 months may,june,july,august),third quarter and then so on for the whole two years so even if statements are missing for a one or two months in any quarter then it would be all right as there will be enough statements to prove that you did live togather.

Has your husband got any pay slips?? which can also show his address and then you can put some documents from your side with your name on it to prove the joint address.

Did you or your husband receive any documents from bank when you or he opened joint or individual account?if yes then include them.

Has your husband or you got any p60 or p45?

Do you and your husband purchase anything online as normally they send you an invoice with your address on it!

Basically include everything which would give some weight to your application.

I know its just so stressful to collect these letters in these two years as most of the times when you call council,BT,and water they refuse to give paper statement as they say all debits appear on your bank statements and they do'nt do itemised billing as they are following paperless scheme.

That looks fine but I suggest you get a letter from the parents stating that you live with them. Have you passed Life in the UK test or ESOL? Add it to your list, good luck
