Tier 2 Rejected

Hi Guys,

My tier 2 got rejected bcoz of i didnt got salary according to SOC it was suppose to be £28000. Home office said I can make fresh application before my visa runs out which is on 11th Feb 2012.

I need your help on following topics

1. My employer agreed me to pay £28000 from Monday so will it make diff this time when I apply or do I have to show them my recent pay slip that I'm earning £28000?

2. I'm working here from last 2yrs. Are Pay slips are just to show that you are working here from last 6 month or do they check your salary on it?

3. My employer requested additional COS bcoz we applied for only 1 COS and we ran out of COS. How much time it takes for the request to be granted. I put the request in the morning 13th Jan 2012?

4. Suppose my new application goes beyond 11th Feb am i able to work for my current employer or not?

Guys It's Urgent. Any reply Appriciated.

As long as you are paid the required amount by the time of your application you are fine. No you don't have to show payslips.

Payslips are to prove you are working for the employer. Not to check salary.

It depends. Some people here reported from 1 day to 3 weeks. Once you requested additional allocations do email and phone home office. I hope you mentioned the urgency and visa expiry date in the "reasons" when you requested additional allocations.

hmmm you mean make an out of time application?

I Just mention reapplication for tier 2 something like that cant remember it properly. But i did mentioned the valid reason.

I don't know mate. If you do put a expiry date it helps. You can always contact UKBA. I wouldn't recommend withdrawing just to put a reason. When you request a COS allocation it asks for a reason. Wait and see, if it takes too long ring em up.

As long as you make an in time application, (i.e. before 11th Feb 2012) you can continue working for your current employers until a decision has been made by the UKBA. The same terms and conditions of your current visa continue to apply.

hi aditanu, an additional COS costs £175.00... this is what my employer paid for additional COS...

No one can tell you. I was in a similar situation as you and I was allocated a COS within 24 hrs. I know it took some people here up to 3 weeks. You just have to chase them up.

Hi Madona,

I am not sure if I should send a private message. I am new to this forum so don't know which one is the best way to communicate.

My employer applied for a tier 2 sponsorship license on 21 December 2011. They have submitted all the related documents and payment is also made on this passed Monday. Now waiting for final confirmation letter from home office.

I am very worried as my old work permit visa is expiring on 11th Feb 2012. Do you know after making final payment, how long it takes to get a license. Do i have enough time?

Can I make out of time application after 11 feb 2012. I will be over stayer after 11th feb. Looking for your advice. Thanks.

It's possible to apply for Tier 2 after leave's expiry (245HD(b)). However, it's better to apply beforehand.

I was also worried as I learnt from this forum that some cases it took months. But our company got the license after 12 days of online application.

Hi Dr_fish13,

Thanks. Your company must have made a payment on the same day of online application. My company filled and submitted online application on 21st December laast year. Sent documents within 14 days and payment made on 23rd jan 2012. Not sure if 4 weeks periods starts after intial online application submission or after the payment :(

Hi Vinny,

Thanks. 245HD (b) does not mention anything about out of time within UK application. My work permit will expire on 11th feb so if i get COS on 15th feb can i apply under the same transitional arrangement A for work permit holders after 5 days of visa expiring.

Thanks vinny, so I can apply within 28 days after my visa expiry. I guess I could use same transitional arrangement A? Or will be new application? Secondly will it effect my indefinite leave to remain after 2 years.? Thanks for the advice.

Perhaps it may be possible to make a valid application before your leave expires. Then vary the application before a refusal?

Hi,

My Tier-2 visa got rejected yesterday on the basis of the fact that my salary is less by 1,000 GBP than the what should be paid for the Job code that my HR used while applying for the licence. Now my job tittle is Junior Performance Consusltant and this title does not exixt in COP list. So my HR was asked to put the one that most closely matches my job description. The one that she chose and thought most closely matches my job description is Operations Analyst and is paid 27,000 GBP whereas my role pays 26,000. I do not understand how that explains that I should be getting the exact same salary as a job that does not exactly but most closely matches my job description.

I am switchin from tier 1 post study and have been working for my current employer for mopre than 6 months.

I am now taking the legal route to lodge my appeal.
Do you think i have a fair ground to appeal on ?

Quick response will be much appreciated.

I am not sure if you can actually take a legal route, but yes you can make a fresh application. Ask for a raise, get a promotion letter, match the salary and re sub.

My PSW has already expired so I cannot make a fresh application. If my employer agrees to raise my salary to £27,000 before the hearing, would that be considered in the appeal.

Unfortunately, the appeal probably would not consider a salary increase after the submission of the application due to section 85A.
