Tier1 and Tier4 validity

Post by desperado1306 » Tue Jan 17, 2012 1:44 am

Dear members,

I have got Tier1 in October 2010 valid till September 2012 and in July 2012 I got Tier4 valid till September 2013. I arrived in the UK in August 2011.

Although, Tier4 was given after Tier1, there is no cancellation stamp on Tier1 visa. How can I check if Tier1 is still valid, highly unlikely though.

Thanks.

You cannot hold more than one visa - when your latest one was issued, your previously obtained visa immediately becomes invalid and you cannot use it.

Why would you switch from Tier 1 to Tier 2. When your company asked you for Visa processing, you could have informed them that you already have a Tier - 1 visa.

As far as I know, there is no option to use the Tier -1 visa now. Unless UKBA tells you otherwise. It might be worth a shot checking with UKBA regarding the same. It won't hurt if you double check.

Tier-4 is a Student Visa I reckon?
Well It was mistake on ukba part also as they did not cancel your Tier-1 visa.. Have you checked whether there is any specific rule somewhere mentioned on their guidelines about holding different category visa at a same time? Not sure about UK policies in this matter however other countries like US allow a person to hold differnt category visa at a same time (like Business B1 and Work Permit H1 )..

If you are apealing UKBA, I would strongly recomment you to go through a solicitor as that would help your case..

This is not UKBA mistake as for as I know because I got my Tier1 on May 2011 even though my PSW is valid till Feb. 2012 but there is no cancellation stamp on my PSW Visa. I also travelled but when I return back at heathrow airport then immigration officer wrote visa number(tier1) from my BRP to Passport and he also explained me if you get new leave while your previous leave still valid then your most recent leave will come into effect and your previous valid leave automatically invalid.

Please be clearer. How can you have got a tier 4 visa in July 2012? Do you mean July 2011? What type of tier 1 visa did you have? Did you apply for the tier 4 leave from inside or outside the UK?

I believe the dates on the original post are a bit misleading as suggested by Greenie.
