basic disclosure Scotland for ILR

Hi Every one
Some one please confirm CCJ default payments(loan/credit card) will come disclosure Scotland 'basic' check or not.
If yes then will that effect ILR?
If you dont have CCJ in 'basic'disclosure Scotland check then this means that no CCJ on your name?

Thanks ceyes for your fasr reply.But SRA will take days and i have to apply my ILR ASAP
I have chcked in my credit report and trust online.IN both i dont have any CCJ's.But if i get after my application then it may be a problem.I have to apply only by post as it is for 10 years ILR

Get your report from Experian and also from Equifax to be on the safe side. If there is any CCJ against you, they will appear on your credit report.

I have checked in Equifax and there are none at the movement.
But what if i get one after submission of application for 10 years ILR
will that cause any problems?

Are you expecting a CCJ?

I guess one would know in advance if they will get CCJ. It only happens if you don't make a payment to creditor and they go to the court.

You should have known it by now as you don’t get CCJ over night. If you owe money to a bank or someone, they normally chase you first and send you loads of letters. And if you don’t respond and don’t agree to pay the minimum amount, then they sometimes sell your loan to a debt collector which can take you to court for not paying it. (or sometimes the company can directly take you to court).

If they are 4 to 5 years old and are not on your credit report, then hopefully you should be fine.

Payment defaults are still in credit file.\this will eb there for 6 years but there are no CCJ in credit file and in Trust online.

Would bank default on credit file affects anyway?

If you have two or three old bank defaults and you stared paying them monthly?

There should be no issue as long as it’s not a court judgement.

Court Information and other public records
Judgments are issued as a result of County or High Court action. If a Creditor/Claimant (the person looking to claim the money from you) is owed a sum of money by you they may raise a claim against you in either the County or High Court, for recovery of these monies. If the court agrees that the Creditor/Claimant is owed the money, then a Judgment will be granted by the court against the Individual (Defendant). The monetary value of this Judgment will be for the amount due and any associated costs. In Scotland similar judgments given in the Sheriffs Courts are called Decrees. Equifax receives this information from Registry Trust Ltd. Registry Trust Ltd is a non-profit making company, contracted by the Lord Chancellor, through the Ministry of Justice, to maintain the statutory public Register of Judgments, Orders and Fines covering courts in England and Wales. As well as holding public registers covering money Judgments/Decrees in Scotland, Isle of Man, Northern Ireland and Jersey, Registry Trust Ltd acts as a clearing house for Judgments registered in Eire. Details of all these Judgments/Decrees, and any subsequent amendments, are passed to the credit reference agencies for inclusion in their Reports.

How long is this data kept on my Credit File?
This information is held on file for 6 years from the date of Judgment, even if it is satisfied/paid. However, if you satisfy or pay the outstanding amount within a month of the judgment being issued, it will not show on your credit report.

What can I do if I believe there is Court information which is registered incorrectly?
If you believe a County Court Judgment/Decree has been registered incorrectly, you should contact the relevant court directly.
