PSW- Tier 2 General Visa (Rejected now reapplying)

Dear All,

I am on PSW till Jan 2013, I am with my employer June 2010, my employer is willing to sponsor me and has got COS in july 2011. I made an application to switch to Tier 2 from PSW in Aug but was unaware of minimum salary level for the role and got rejection from home office in Oct 2011.

My employer checked with Home office and they clarified the situation that its because of the salary. My employer applied and got another COS in Oct 2011. My employer gave me a raise and promoted me to cross the minimum salary on Nov 1, 2011 and gave me a promotion letter as well.

I will apply for tier 2 again end of this month to include this month salary.

My question is- Now that I have the salary level which crosses the min required, but since its just 3 months of salary( I do have letter stating my annual salary given by my employer) and 3 months ago the salary level were below the min hourly required and on the application form it ask for evidence of pay as last 6 months, Is there any concerns or issue in applying or is it fine as long as I am getting paid the minimum salary levels.

Any help will be highly appreciated.

Hi RaOne,

Can you please brief what you are working as and how much you are earning? Do you know the SOC code?
As long as you meet the salary required when applying for a VISA, it should be fine.
The UKBA asks you for 6 months payslips to prove that you have been working for the same employer for the same position for more than six months. You do not need to earn the minimum salary for six months.

Your payslips are to prove that you are working for the company for the last 6 months. Its not a proof of salary.

As long as you are paid on a required salary according to SOC by the time of your application you are fine.

You got nothing to worry here :)

Hi,

I am working as Recruiting Manager now (Nov 1 2011 onwards).

SOC CODE: 1135
Personnel, training and industrial relations managers and my JD on prifile is :

My salary when the visa was rejected was 25,000 / year ( 36.5 hrs/ week).

From Nov 1 2011- its now 31,500 / Year.

Min salary quoted on code of practice is 16.03/hr. I hope I am doing calcualtion rights - 31,500 comes to be a little more than min threshold.

The new salary 31,500 should be perfectly fine to apply.
Ii works up to £16.1538 ph for a standard 37.5 hrs per week. This is definitely above the required rate of required £16.03 ph.
Remeber to tell your employer to fill the COS correctly and also get a copy of your COS so that you can put the appropriate information in your application.

If you are working 36.5 hrs per week. Then you would be earning about £16.596 ph. This should be fine. As long as your employer has specified 36.5 Hours per week in COS and you have done the same on your application.

One last thing-

On the tier 2 application form in section J.

It asks for Certificate of Sponsorship reference number - This I know

It also asks Previous Certificate of Sponsorship reference numbers- Does this mean I need to fill the number of previous COS which I have used but got rejected as salary threshold was not met...

Just one last thing. The last time applied for the Tier 2 was in October and at that time I was single, and now I married.

As the form ask for marital status, do I need to show marriage certificate?

you fill the application form according to your current situation!

currently, you are MARRIED, so put that it.

Also, you dont need to tell them EVERYTHING that has happened to you unless its immigration-related. e.g. if your leqal name has changed as a result of marriage etc. then yes, you do mention it/provide evidence etc. otherwise its irrelevant

Thanks, I just wanted to make sure it wont create problems later, as my date of mar is Nov 1 and I will need to file for dependent for my wife later on once my tier 2 is approved.

hi raone...

may i ask if you have already applied?? if so, may i know how long it took for UKBA to take the application fees from your account??

i am asking because i have sent my application again on the 13th Jan and I still have not heard from them.. I have also not seen any money being taken out of my account by UKBA.. so i am just worried..
