Start to work before work permit: can he apply for ILR?

Ask a question on behalf of a friend regarding application for ILR.

He started to work on 1th Aug 2007, but the work permit was issued on 9th Aug, and the work visa was issued on 12 Sep. He was a PHD student in 2007, and was holding a student visa. HR said Aug and Sep are summer holiday, so he could work.

He has worked for 5 years now, and would like to apply for an ILR. Do you think the starting date will be a problem? If not, how to deal with that?

Another thing is he will stay here for 10 years this summer. If he applies 10 yr PR, will it be easier because the starting date of work is less noticeable?

I am in same situation. I started in Nov 2006 and obtained out of country WP in Jan 2007. Entered back in uk in Feb. I am applying next week so will let you know how it goes. On my employer letter i have worded that i started in feb on this work permit. Hope it helps.
