Dear All,


My details are as follows :

February 2007 to September 2011 : Work Permit
October 2011 till Now : Jobless. (Company Closed down)
November 2011 : Applied for Tier 2 (Within 60 days from being Redundant)
12/01/2012 : Tier 2 Approval letter dated 10/01 received.
BRP and Passport : Still waiting to receive.....



When can I apply for ILR.

My question is because of the rule of the one months payslip. If I join in the january then I will get the proportionate salary and then can I apply for ILR or should I get the February's full payslip and then apply or should I wait for three months and then apply...

You should have 4 years 7 months

You have already banked 4 years 7months so 5 months from the date your new Tier 2 visa is issued, your can apply for ILR.

Be ready to answer the following though;
You had 28-days after being redundant to regularize your stay in a different category, so there could potentially be an issue with overstaying....BUT, if your present Tier 2 Visa is granted, they you should already be over that hurdle, since they will be looking into that now......Good luck

By the way it is not 28 days, it has been changed to 60 days and I have received my tier 2 visa today

Mate ..

Just wait for 5 year on workpermit and you can apply... You will fine..
Do you come in shortage skills category?
